WHEREAS, the City of Saint Paul and Ramsey County executed an Aa eement regazding the
renovation of the Saint Paui City Ha11/Court House (CH/CI�, effective January 24, 1989; and
WHEREAS, the Agreement provides for the assumption of fmanciai responsibility for the
renovation by the County, up to $48,582,005 plus non-arbitrage interest income; and
WHEREAS, the renovation project is nearing completion and it appeazs the renovataon will
not require the use of all of the non-arbitrage interest income; and
WHEREAS, the City and the Counry are interested in reducing the 1994, 1945, and 1996 taa�
levies and their impact on the citizens of the City and County; and
WHEREAS, the CHlCH committee has recommended that the JOINT POWERS
AGREEMENT be amended to allow Ramsey County to reduce the Debt Service levy for
1994, 1995, and 1996 through the use of non-azbitrage interest earnings; now
THEREFORE BE IT RESOLVED, the City Councii approves the AMENDMENT
(attached) to the Joint Powers Agreement dated Januazy 24, 1484.

The City of Saint Paul and Ramsey County have an opportunity to reduce
the County's property tax levy by applyinq the non-arbitrage interest income
earned from the sale of bonds by Ramsey County to fund the renovation
of the Saint Paul City Ha11JRamsey County Courthouse.
Ramsey County's property tax levy is reduced to the benefit of the
citizens of the City of Saint Paul and of Ramsey County.

WF3EREAS, the City of Saint Paul and Ramsey County executed an Agreement re�arding the
renovation of the Saint Paul City HalURamsey County Courthouse, effective 3anuary 24, 1989; and
WHEREAS, the Agreement pro��ides for the assumption of financizl responsibility for the renovation
by the County, up to �48,552,005 plus non-arbitrage interest income; and
WHEREAS, tne renovatian project is nearing completion and it does not appear that the renovation
will require the use of all of the non-arbitra�e interest income; and
�T�rHEREAS, Ramsey County wishes to apply non-arbitrage interest income not required for the
renovation to reduce the County's property t� levies, to the benefit of the citizens of the City of
Saint Paul and of Ramsey County; and
WH.EREAS, the parties wish to amend the Agreement;
I�TOW THEREFORE, it is agreed by and beriveen the parties that:
1. The followin� is added as Section I.F.9. and as substitution for any existin; Section I,F.9. of
ihe A�eement beTween the County of Ramsey and the City of Saint Paul, effective Januzsy 24, 1989.
9. The Board ofRamsey County Commissioners may appropriate for the 1994 Ramsey
. County Budjet, ihe 1995 Ramsey County Budget and the 199b Ramsey County
budget, non-aroitrage reinvestment income from the sale of bonds by Ramsey County
to fund the renovation of the Saint Paul City Ha1URamsey County Courthouse,
pro��ided that Ramsey County shall receive approval, by way of resolution, from the
City HalllCourtfiouse Renovation Committee prior to each annual apnropriation, if
the Committee is sYill in existence, or by the Saint Paui City Council if the City
HalUCourthouse Renovation Committee is no longer in existence.
2, Except as modified herein, all provisions of the Agreement between the County of Ramsey
and the City of Saint Paul regarding the renovation of the Saint Paui City HalUItamsey Cour,ty
Courthouse shall remain in full force and effect.
