1 WHEREAS, Saint Paul Pub 'c Health has requested the City Council to hold public hearings
2 to consider the advisability and n ssity of ordering the repair or wrecking and removal of a two
3 story, wood frame dwelling and w storage shed rear yazd located on property hereinafter
4 refened to as the "Subject Propert " and commonly known as 298 Sherburne Avenue. This
5 property is legally described as foll ws, to wit:

7 Lot 8, Block 2, Chamber's ddition to the City of St. Paul, Minnesota.

9 WHEREAS, based upon th records in the Ramsey County Recorder's Office and
10 information obtained by Saint Paul blic Health on or before August 23, 1994, the following are
11 the now known interested or respo sible parties for the Subject Property: Evalyn Charnell, 285
12 Sherburne Avenue, St. Paul, MN 55103; Tina Kiprose, 285 Sherburne Avenue, St. Paul, MN
13 55103; Sylvia Kiprose, 285 Sherbu e Avenue, St. Paul, MN 55103.

15 WHEREAS, Saint Paul Pu ic Health has served in accordance with the provisions of
16 Chapter 45 of the Saint Paul Legis tive Code an order identified as an"Order to Abate Nuisance
17 Building(s)" dated August 18, 199 ; and

19 WHEREAS, this order info ed the then known interested or responsible parties that the
20 structure located on the Subject Pr perty is a nuisance building(s) pursuant to Chapter 45; and
21
22 WHEREAS, this order info med the interested or responsible parties that they must repair or
23 demolish the structure locatec� on e Subject Property by September 19, 1994; and
24
25 WHEREAS, the enforceme t officer has posted a placard on the Subject Property declaring
26 this building(s) to' constitute a nui ce condition; subject to demolition; and
27
28 WHEREAS, this nuisance ndition has not been corrected and Saint Paul Public Health
29 requested that the City Clerk sch le public hearings before the Legislative Hearing Officer of the
30 City Council and the Saint Paul Ci Council; and

32 WHEREAS, the interested d responsible parties have been served notice in accordance
33 with the provisions of Chapter 45 f the Saint Paul Legislative Code, of the time, date, place and
34 purpose of the public hearings; an

36 WHEREAS, a hearing was eld before the Legislative Hearing Officer of the Saint Paul City
37 Council on Tuesday, October 18, 994 to hear testimony and evidence, and after receiving
38 testimony and evidence, made the ecommendation to approve the request to order the interested or
39 responsible parties to make the Su 'ect Property safe and not detrimental to the public peace, health,
40 safety and welfare and remove its lighting influence on the community by rehabilitating this
41 structure in accordance with all ap licable codes and ordinances, �r in the alternative by
42 demolishing and removing the stru ture in accordance with all applicable codes and ordinances.

1 The rehabilitation or demolition of e structure to be completed within fifteen (15) days after the
2 date of the Council Hearing; and

4 WHEREAS, a hearing was eld before the Saint Paul City Council on Wednesday, October
5 26, 1994 and the testimony and evi ence including the action taken by the Legislative Hearing
6 Officer was considered by the Cou cil; now therefore

8 BE IT RESOLVED, that b upon the testimony and evidence presented at the above
9 referenced public hearings, the Sai t Paul City Council hereby adopts the following Findings and
10 Order concerning the Subject Pro rty at 298 Sherburne Avenue:

12 1. That the Subject Pro rty comprises a nuisance condition as defined in Saint Paul
13 Legislative Code, C apter 45.

15 2. That the costs of de olition and removal of this building(s) is estimated to exceed
16 three thousand doll ($3,000.00).

18 3. That there now exis and has existed multiple Housing or Building code violations at
19 the Subject Property

21 4. That an Order to A te Nuisance Building(s) was sent to the then known responsible
22 parties to conect th deficiencies or to demolish and remove the building(s).

24 5. That the deficiencie causing this nuisance condition have not been corrected.

� 26 6. That Public Health s posted a placard on the Subject Property which declares it to
27 be a nuisance condi on subject to demolition.

29 7. That this building h s been routinely monitored by the VacantlNuisance Buildings
30 Code Enforcement rogram.

32 8. That the known inte ested parties and owners are as previously stated in this
33 resolution and that e notificadon requirements of Chapter 45 have been fulfilled.

37 The Saint Paul City Counc hereby makes the following order:

39 1. The above referenced inter sted or responsible parkies shall make the Subject Property safe
40 and not detrimental to the ublic peace, health, safety and welfare and remove its blighting
41 influence on the communit by rehabilitating this structure and correcting all deficiencies as
42 prescribed in the above ref renced Order to Abate Nuisance Building(s) in accordance with
43 all applicable codes and or inances, or in the alternative by demolishing and removing the
44 structure in accordance wi a11 applicable codes and ordinances. The rehabilitation or
45 demolition and removal of e structure must be completed within fifteen (15) days after the
46 date of the Council Hearin .

1 2. If the above conective actio is not completed within this period of time the City of Saint
2 Paul, Public Health, Housin Code Enforcement Section is hereby authorized to take
3 whatever steps are neces to demolish and remove this structure, fill the site and charge
4 the costs incuned against th Subject Property pursuant to the provisions of Chapter 45 of
5 the Saint Paul Legislative C e.

7 3. In the event the building is be demolished and removed by the City of Saint Paul, all
8 personal property or fixture of any kind which interfere with the demolition and removal
9 shall be remov� from the operty by the responsible parties by the end of this time period.
10 If all personal property is n' removed, it sha11 be considered to be abandoned and the City
11 of Saint Paul shall remove d dispose of such property as provided by law.

13 4. It is further ordered, that a opy of this resolution be mailed to the owners and interested
14 parties in accordance with apter 45 of the Saint Paul Legislative Code.
