This property is le ly described as follows, to wit: 6 7 Lot 13, Block 2, Stone & orton's Addition to the City of St. Paul. 8 9 WHEREAS, based upon th records in the Ramsey County Recorder's Office and 10 information obtained by Saint Paul �ublic Health on or before September 6, 1994, the following are 11 the now known interested or respo sible parties for the Subject Property: Pat Fisher, 2500 Hwy 88, 12 Mpls. , Mn 55418; Mid America k, 1815 North St. Paul Rd. , St. Paul, Mn 55109; Richard & 13 Kathleen Kotoski, & Robert B. & atharine Kuyper, 2570 Grotto Street N. , Roseville, MN 55113. 14 15 WHEREAS, Saint Paul Pub ic Health has served in accordance with the provisions of 16 Chapter 45 of the Saint Paul Legisl tive Code an order identified as an "Order to Abate Nuisance 17 Building(s)" dated August 4, 1994; d 18 19 WHEREAS, this order info ed the then known interested or responsible parties that the 20 structure located on the Subject Pr rty is a nuisance building(s) pursuant to Chapter 45; and 21 � 22 WHEREAS, this order info ed the interested or responsible parties that they must repair or 23 demolish the structure located on th Subject Property by September 3, 1994; and 24 25 WHEREAS, the enforcemen I officer has posted a placard on the Subject Property declaring 26 this building(s) to constitute a nui ce condition; subject to demolition; and 27 28 WHEREAS, this nuisance c ndition has not been corrected and Saint Paul Public Health 29 requested that the City Clerk sched e public hearings before the Legislative Hearing Officer of the 30 City Council and the Saint Paul Cit Council; and 31 I ' 32 WHEREAS, the interested d responsible pazties have been served notice in accordance 33 with the provisions of Chapter 45 o the Saint Paul Legislative Code, of the time, date, place and 34 purpose of the public hearings; and I 35 36 WHEREAS, a hearing was ld before the Legislative Heanng Officer of the Saint Paul City 37 Council on Tuesday, October 18, 1 4 to hear testimony and evidence, and after receiving 38 testimony and evidence, made the r mmendation to approve the request to order the interested or 39 responsible parties to make the Subj t Property safe and not detrimental to the public peace, health, 40 safety and welfare and remove its b ghting influence on the community by rehabilitating this 41 structure in accordance with all appl cable codes and ordinances, or in the alternative by 42 demolishing and removing the struct re in accordance with all applicable codes and ordinances. a�-�5n� � 1 The rehabilitation or demolition o the structure to be completed within fifteen (15) days after the 2 date of the Council Hearing; and I 3 I 4 WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, October 5 26, 1994 and the testimony and ev dence including the action taken by the Legislative Hearing 6 Officer was considered by the Co cil; now therefore 7 I 8 BE IT RFSOLVED, that b sed upon the tesdmony and evidence presented at the above 9 referenced public hearings, the Sai t Paul City Council hereby adopts the following Findings and 10 Order concerning the Subject Pro rty at 1288 Payne Avenue aka 648 Hyacinth: 11 12 1. That the Subject Pro rty comprises a nuisance condition as defined in Saint Paul 13 Legislative Code, C apter 45. 14 15 2. That the costs of de I ' olition and removal of this building(s) is estimated to exceed 16 three thousand doll ($3,000.00). 17 18 3. That there now exist and has existed multiple Housing or Building code violations at 19 the Subject Property.l 20 21 4. That an Order to Ab te Nuisance Building(s) was sent to the then known responsible 22 parties to conect the eficiencies or to demolish and remove the building(s). 23 24 5. That the deficiencies �' using this nuisance condition have not been corrected. 25 26 6. That Public Health h s posted a placard on the Subject Property which declares it to 27 be a nuisance conditi n subject to demolition. 28 29 7. That this building ha been routinely monitored by the Vacant/Nuisance Buildings 30 Code Enforcement P gram. 31 32 8. That the known inter ted parties and owners are as previously stated in this 33 resolution and that th notification requirements of Chapter 45 have been fulfilled. 34 I 35 ORDER 36 37 The Saint Paul City Council ereby makes the following order: 38 i 39 l. The above referenced interes or responsible parties shall make the Subject Property safe 40 and not detrimental to the pu lic peace, health, safety and welfare and remove its blighting 41 influence on the community y rehabilitating this structure and conecting all deficiencies as 42 prescribed in the above refer nced Order to Abate Nuisance Building(s) in accordance with 43 all applicable codes and ordi ces, or in the alternative by demolishing and removing the 44 structure in accordance with 1 applicable codes and ordinances. The rehabilitation or 45 demolition and removal of th structure must be completed within fifteen (15) days after the 46 date of the Council Hearing. I A ��I J�Y 1 i 2 2. If the above corrective acti n is not completed within this period of time the City of Saint 3 Paul, Public Health, Housi g Code Enforcement Section is hereby authorized to take 4 whatever steps are neces to demolish and remove this structure, fill the site and charge 5 the costs incuned against e Subject Property pursuant to the provisions of Chapter 45 of 6 the Saint Paul Legislative e. 7 8 3. In the event the building is o be demolished and removed by the City of Saint Paul, all 9 personal property or fixtur of any kind which interfere with the demolition and removal 10 sha11 be removed from the roperty by the responsible parties by the end of this time period. 11 If a11 personal property is n t removed, it sha11 be considered to be abandoned and the City 12 of Saint Paul shall remove d dispose of such property as provided by law. 13 14 4.
