11 information obtained by Saint Pa Public Health on r before August 25, 1994, the following are

22 Building(s)" dated August 18, 19 ; and

3 Council on Tuesday, October 18 1994 to hear testimony and evidence, an after receiving
4 testimony and evidence, made th recommendation to approve the request order the interesterl or
5 responsible parties to make the S bject Property safe and not detrimental o the public peace, health,
6 safety and welfare and remove it blighting influence on the community y rehabilitating this
7 structure in accordance with all a plicable codes and ordinances, or i the alternative by
8 demolishing and removing the s cture in accordance with all appli ble codes and ordinances.
9 The rehabilitadon or demolition the structure to be completed w' in fifteen (15) days after the
10 date of the Council Hearing; and I

12 WHEREAS, a hearing wa held before the Saint Paul ty Council on Wednesday, October
13 26, 1994 and the testimony and e idence including the actio en by the Legislative Hearing
14 Officer was considered by the Co ncil; now therefore

16 BE IT RFSOLVED, that b� sed upon the testimo and evidence presented at the above
17 referenced public hearings, the S t Paul City Counci hereby adopts the following Findings and
18 Order concerning the Subject Pro rty at 485 Kenny oad:

20 1. That the Subject Pr rty comprise a nuisance condition as defined in Saint Paul
21 Legislative Code, C apter 45.

23 2. That the costs of de olition removal of this building(s) is estimated to exceed
24 three thousand doll ($3, .00).

26 3. That there now exist and as existed multiple Housing or Building code violations at
27 the Subject Property.',

29 4. That an Order to Ab � Nuisance Building(s) was sent to the then known responsible
30 parties to conect th eficiencies or to demolish and remove the building(s).

32 5. That the deficien es using this nuisance condition have not been corrected.

34 6. That Public H th h posted a placard on the Subject Property which declares it to
35 be a nuisance onditi subject to demolidon.

37 7. That this b ilding has I been routinely monitored by the Vacant/Nuisance Buildings
38 Code En rcement Pr gram.

40 8. That e known intere ted parties and owners are as previously stated in this
41 resol tion and that the notification requirements of Chapter 45 have been fulfilled.

6 structure in accordance w all applicable codes and ordinan . The rehabilitation or
7 demolition and removal o, the structure must be completed w thin fifteen (15) days after the

10 2. If the above conective ac � n is not completed within th' period of time the City of Saint
11 Paul, Public Health, Hous � g Code Enforcement Sectio is hereby authorized to take
12 whatever steps are neces to demolish and remove is structure, fill the site and charge
13 the costs incurred against e Subject Property purs t to the provisions of Chapter 45 of
14 the Saint Paul Legislative ode.

16 3. In the event the building is ��,to be demolished removed by the City of Saint Paul, all
17 personal property or fixtur s of any kind whi interfere with the demolition and removal
18 shall be removed from the roperty by the r sponsible parties by the end of this time period.
19 If all personal property is n t removed, it all be considered to be abandoned and the City
20 of Saint Paul shall remove d dispose o such property as provided by law.

22 4. It is further ordered, that a opy of t" resoludon be mailed to the owners and interested
23 parties in accordance with hapter 4 of the Saint Paul Legislative Code.

the costs incurred against the real state as a special assessment to be collected in the same
manner as taxes.

2 VVHEREAS, a hearing was eld before the Legislative Hearing Officer of the Saint Paul City
3 Council on Tuesday, October 18, T 94 to hear testimony and evidence, and after receiving
. 4 testimony and evidence, made the " mmendation to approve the request to order the interested or
5 responsible parties to make the Su ect Property safe and not detrimental to the public peace, health,
6 safety and welfare and remove its lighting influence on the community by rehabilitating this
7 structure in accordance with all ap 'cable codes and ordinances, Q in the alternative by
8 demolishing and removing the stru re in accordance with all applicable codes and ordinances.
9 The rehabilitation or demolition of e structure to be completed within fifteen (15) days after the
10 date of the Council Hearing; and j

12 WHEREAS, a hearing was eld before the Saint Paul City Council on Wednesday, October
13 26, 1994 and the testimony and evi' ence including the action taken by the Legislative Hearing
14 Officer was considered by the Cou � cil; now therefore

16 BE IT RESOLVED, that b upon the testimony and evidence presented at the above
17 referenced public hearings, the Sai t Paul City Council hereby adopts the following Findings and
18 Order concerning the Subject Pro rty at 485 Kenny Road:

20 1. That the Subject Pro rty comprises a nuisance condidon as defined in Saint Paul
21 Legislative Code, C apter 45.

23 2. That the costs of de olition and removal of this building(s) is estimated to exceed _
24 three thousand doll ($3,000.00).

26 3. That there now exist and has existed multiple Housing or Building code violations at
27 the Subject Property

29 4. That an Order to Ab te Nuisance Building(s) was sent _to the then known responsible
30 parties to correct th deficiencies or to demolish and remove the building(s).

32 5. That the deficiencies I causing this nuisance condition have not been corrected.

34 6. That Public Health I s posted a placard on the Subject Property which declares it to
35 be a nuisance condi n subject to demolition.

38 Code Enforcement ogram.

41 resolution and that e notification requirements of Chapter 45 have been fulfilled.
