That the Subject Pr rty comprise a nuisance condition as defined in Saint Paul 21 Legislative Code, C apter 45. 22 23 2. That the costs of de olition removal of this building(s) is estimated to exceed 24 three thousand doll ($3, .00). 25 26 3. That there now exist and as existed multiple Housing or Building code violations at 27 the Subject Property.', 28 29 4. That an Order to Ab � Nuisance Building(s) was sent to the then known responsible 30 parties to conect th eficiencies or to demolish and remove the building(s). 31 32 5. Mn 55102, Attn: Aaron Rubenstein. 19 20 WHEREAS, Saint Paul Pub c Health has served in accordance with the provisions of 21 Chapter 45 of the Saint Paul Legisl tive Code an order identified as an "Order to Abate Nuisance 22 Building(s)" dated August 18, 1994 �; and 23 24 25 WHEREAS this order infor II ed the then known interested or responsible parties that the � 26 structure located on the Subject Pro rty is a nuisance building(s) pursuant to Chapter 45; and 27 28 the must r air or 29 WI�REAS, this order infor ed the interested or responsible parties that y ep 30 demolish the structure located on th Subject Property by September 19, 1994; and 31 32 WHEREAS, the enforcemen I officer has posted a placard on the Subject Property declaring 33 this building(s) to constitute a nui condition; subject to demolition; and 34 : 35 WHEREAS, this nuisance co dition has not been corrected and Saint Paul Public Health 36 requested that the City Clerk schedu e public hearings before the Legislative Hearing Officer of the 37 City Council and the Saint Paul Ci I Council; and 38 , 39 WHEREAS, the interested responsible parties have been served nodce in accordance 40 with the provisions of Chapter 45 of',the Saint •Paul Legislative Code, of the time, date, place and 41 purpose of the public hearings; and �� . . ��-i��►� . 1 2 VVHEREAS, a hearing was eld before the Legislative Hearing Officer of the Saint Paul City 3 Council on Tuesday, October 18, T 94 to hear testimony and evidence, and after receiving . 4 testimony and evidence, made the " mmendation to approve the request to order the interested or 5 responsible parties to make the Su ect Property safe and not detrimental to the public peace, health, 6 safety and welfare and remove its lighting influence on the community by rehabilitating this 7 structure in accordance with all ap 'cable codes and ordinances, Q in the alternative by 8 demolishing and removing the stru re in accordance with all applicable codes and ordinances. 9 The rehabilitation or demolition of e structure to be completed within fifteen (15) days after the 10 date of the Council Hearing; and j 11 12 WHEREAS, a hearing was eld before the Saint Paul City Council on Wednesday, October 13 26, 1994 and the testimony and evi' ence including the action taken by the Legislative Hearing 14 Officer was considered by the Cou � cil; now therefore 15 16 BE IT RESOLVED, that b upon the testimony and evidence presented at the above 17 referenced public hearings, the Sai t Paul City Council hereby adopts the following Findings and 18 Order concerning the Subject Pro rty at 485 Kenny Road: 19 20 1. That the Subject Pro rty comprises a nuisance condidon as defined in Saint Paul 21 Legislative Code, C apter 45. 22 � 23 2. That the costs of de olition and removal of this building(s) is estimated to exceed _ 24 three thousand doll ($3,000.00). 25 26 3. That there now exist and has existed multiple Housing or Building code violations at 27 the Subject Property 28 29 4. That an Order to Ab te Nuisance Building(s) was sent _to the then known responsible 30 parties to correct th deficiencies or to demolish and remove the building(s). 31 32 5. That the deficiencies I causing this nuisance condition have not been corrected. 33 � 34 6. That Public Health I s posted a placard on the Subject Property which declares it to 35 be a nuisance condi n subject to demolition. 36 � 37 7. That this building h been routinely monitored by the Vacant/Nuisance Buildings 38 Code Enforcement ogram. 39 40 8.
