1 WHEREAS, Chapter 18 o the Saint Paul Legislative Code provides for a
2 Property Code Enforcement Boar of Appeals and is delegated with the authority to
3 hear and decide appeals relative t the application and interpretation of the State
4 Building Code; and

6 WHEREAS, The Council ' contemplating transferring these functions from the
7 Property Code Enforcement Boar of Appeals and assigning those functions to the
8 Board of Zoning Appeals; and
9
10 WHEREAS, The transfer f functions to the Board of Zoning Appeals would
11 necessitate amending the Zoning ode in the manner provided in Minnesota Statutes,
12 section 462.357, which includes th review and recommendation by the Planning
13 Commission prior to the City Co cil enacting such amendments; and

15 WHEREAS, It is the inte of the City Council to consider amending the Codes
16 so as to transfer the functions of e
17 Property Code Enforcement Bo of Appeals and assigning those functions to the
18 Board of Zoning Appeals; now t refore be it

Moving enforcement appeals to the Legi tive Hearing Officer leaves a void for Building Code
Administrative Appeals which can be fill by the Zoning Board. This change is necessary to comply with
the State Building Code. The City Atto y advises that this resolution is required to have the Zoning
Board review the language changes.
ADVANTAGES IF APPHOVED:
This will ultimately enable all enforceme appeals to be heard by the Legislative Hearing �fficer and for
