WHEREAS, as a condition of the vacation, hereinafter called vacation file number 1&1994, of
certain streets and alleys to accommodate the construction and operation of the Arlington High
School, Independent School District 625 has agreed to dedicate certain right-of-way easements,
including property described as:
that part of Lot 3, Block 15, RICE ST'REET VILLAS, according to the recorded plat
thereof, Raxnsey County, Minnesota, lying within the circum£erence of a circle having a
radius of 55 feet, the center of which circle is a point on the centerline of Albemarle
Street 56.5 feet south of, as measured along said centerline, the south line of Nebraska
Avenue,
part of which property is owned by Gary F. Hegner and Frederick A. Rusch; and
WHEREAS, Cary F. Hegner and Frederick A. Rusch are unwilling to voluntarily convey the
property for permanent easement; and
WHEREAS, in arder to accelerate tl�e process, the school district desires to engage legal
counsel to commence eminent domain proceedings pursuant to Minnesota Statutes Secuon
440.08 on behalf of and in the name of the City of Saint Paul;
NOW THEREFORE BE IT RESOLVED, that Independent School District 625 is hereby
authorized to pursue acquisition of the property required to comply with the conditions of the
said vacation file number 18-1494, on behaif of and in the name of the City of Saint Paul, and,
at its own expense, to engage council to assist in such acquisition.
