RESOLVED, that upon the petition of Robert M. Doody, per Finance Department File No. 17-
1994, that part of the alley in Block 1, Denslow's Addition to the City of St. Paul, bounded by,
Front Avenue, Kent Street, Stinson St eet and Mackubin Street, hereinafter described, is hereby
vacated and discontinued as public pr perty.
The vacated area is described �s follows:
That part of the alley a joining lots 3 and 28, Block 1, Denslow's Addition to St.
Paul.
This vacation shall be subject I the following conditions:
1. That this vacati shall be subject to the terms and condition of Chapter
130, codified M ch 1, 1981, of the Saint Paul Legislative Code as
amended.
2. That the petitio er, his heirs and assigns shall pay $500.00 as an
administrative f e for this vacation which is due and payable within 60 days
of the effective ate of this resolution.
3. That a perman t utility easement shall be retained within the vacated
area to to prot t the interest of Northern States Power Company.
4. That the petiti er, his heirs and assigns, by acceptance of the terms and
conditions of t s resolution agree to indemnify, defend and save harmless
the City of Sai Paul, its officers, and employees from all suits, actions, or
claims of any c aracter brought as a result of injuries or damages received
or sustained by any person, persons, or property on account of this vacation
or petitioner's se of this property, including but not limited to a claim
brought becau of any act of omission, neglect, or misconduct of said
petitioner of b cause of any claims or liability arising from any violation of
any law or re lation made in accordance with the law, whether by the
petitioner or a y of his agents or employees.

1 WHEREAS, the City of Saint Pa is, challenged to set policy, allocate resources and affect
2 decisions of other entities in ways hat support the economic development and neighborhood
3 quality of the city; and
4 WHEREAS choices pertaining to he city's transportation system are key to achieving these
5 community goals; and
6 WHEREAS the City faces severa difficult transportation policy questions including how to
7 provide adequate transit service, ow to alleviate traffic congestion in neighborhoods, how to
8 serve many competing interests h limited resources and infrastructure, how to serve the
9 access needs of businesses, and h w to maintain and improve its position in the regional
10 economy; and
11 WHEREAS, the Saint Paul Pla ng Commission has issued the Transportation Policy Plan:
12 Draft for Community Review and i seeking public comment before preparing a�nal
13 recommendation for consideratio by the Mayor and City Council; and
14 WHEREAS, the Community and conomic Development Committee of the Saint Paul City
15 Council has reviewed the draft Pl n; and
16 WHEREAS, the Minnesota Mu ipal Planning Act requires the Planning Conunission to hold
17 at least one public hearing on th plan before its adoption and has scheduled a hearing on
18 October 21 at its regular Plannin Commission meeting; and
19 WHEREAS, it is desirable for th City Council to also take public testimony on the plan as it
20 considers adoption;
21 NOW THEREFORE BE TT RE OLVED, that the City Council forwards these comments to
22 the Planning Commission for its onsideration as it prepares a�nal Transportation Policy Plan
23 for recommendation to the May and City Council
24 1. The City Council is very s portive of the effort that has gone into the development of
25 this draft Plan, is impresse with the relevance, thoughtfulness, and clarity of the
26 document, and, at this poi t in_the review process, is generally supportive of the general
27 direction of the Plan. '
28 2. The City Council supports he transportation priorities listed in the Plan as follows:
29 a. Transit system imp vement;
30 b. Neighborhood envi nment improvement;
31 c. Influence on region 1 development patterns;

2 e. System capacity addi ons where critical; and
3 f. Neighborhood and d wntown parking management. - -
4 3. The City Council particular wants to emphasize the importance of redesigning the
5 transit system so that it will do a much better job of providing transit-dependent persons
b access to jobs and service a d attract more riders to the system, thus reducing the
7 dependence on the private utomobile.
8 4. The City Council finds that 't is essential for transportation policy to be thoroughly
9 integrated with economic d velopment policy, as well as housing, neighborhood and land
10 use planning, and recomme' ds that these necessary linkages be more distinctly expressed
11 in the Plan.
