Doody, per Finance Department File No. 17- 1994, that part of the alley in Block 1, Denslow's Addition to the City of St. Paul, bounded by, Front Avenue, Kent Street, Stinson St eet and Mackubin Street, hereinafter described, is hereby vacated and discontinued as public pr perty. The vacated area is described �s follows: That part of the alley a joining lots 3 and 28, Block 1, Denslow's Addition to St. Paul. This vacation shall be subject I the following conditions: 1. That this vacati shall be subject to the terms and condition of Chapter 130, codified M ch 1, 1981, of the Saint Paul Legislative Code as amended. 2. That the petitio er, his heirs and assigns shall pay $500.00 as an administrative f e for this vacation which is due and payable within 60 days of the effective ate of this resolution. 3. That a perman t utility easement shall be retained within the vacated area to to prot t the interest of Northern States Power Company. 4. That the petiti er, his heirs and assigns, by acceptance of the terms and conditions of t s resolution agree to indemnify, defend and save harmless the City of Sai Paul, its officers, and employees from all suits, actions, or claims of any c aracter brought as a result of injuries or damages received or sustained by any person, persons, or property on account of this vacation or petitioner's se of this property, including but not limited to a claim brought becau of any act of omission, neglect, or misconduct of said petitioner of b cause of any claims or liability arising from any violation of any law or re lation made in accordance with the law, whether by the petitioner or a y of his agents or employees.
