Th s property is legally described as follows, to wit: . 6 7 8 Lot 1, Block 1, Northern Paci c Addition to the City of St. Paul, except the West 10 9 feet thereof. 10 11 12 WHEREAS, based upon the r ords in the Ramsey County Recorder's Office and 13 information obtained by Saint Paul Pu lic Health on or before August 30, 1994, the following are 14 the now known interested or responsi e parties for the Subject Property: Louise Johnson, 6022 15 Upper 44th Street, Oakdale, Mn 551 8; Lyn Johnson, 6022 Upper 44th Street, Oakdale, Mn 16 55128. I 17 I 18 19 WHEREAS, Saint Paul Public Health has served in accordance with the provisions of 20 Chapter 45 of the Saint Paul Legislati e Code an order identified as an"Order to Abate Nuisance 21 Building(s)" dated June 23, 1994; an I 22 23 24 WHEREAS, this order inform the then known interested or responsible parties that the 25 structure located on the Subject Pro y is a nuisance building(s) pursuant to Chapter 45; and 26 27 28 WHEREAS, this order inform the interested or res nsible arties that the must re air or I� P Y P 29 demolish the structure located on the ubject Property by July 25, 1994; and 30 31 32 WHEREAS, the enforcement fficer has posted a placard on the Subject Property declaring 33 this building(s) to constitute a nuisan condition; subject to demolition; and 34 35 36 WHEREAS, this nuisance co ition has not been conected and Saint Paul Public Health 37 requested that the City Clerk schedul public hearings before the Legislative Hearing Officer of the 38 City Council and the Saint Paul City ouncil; and 39 40 WHEREAS, the interested an responsible parties have been served notice in accordance 41 with the provisions of Chapter 45 of e Saint Paul Legislative Code, of the time, date, place and 42 purpose of the public hearings; and '7'7� ��d P� �-��� 1 WHEREAS, a hearing was held before the Legislative Hea.ring Officer of the Saint Paul City 2 Council on Tuesday, October 4, 1994 o hear testimony and evidence, and after receiving testimony 3 and evidence, made the recommendati to approve the request to order the interested or responsible 4 parties to make the Subject Property e and not detrimental to the public peace, health, safety and 5 welfare and remove its blighting influe ce on the community by rehabilitating this structure in 6 accordance with all applicable codes ordinances, or in the alternative by demolishing and 7 removing the structure in accordance ith all applicable codes and ordinances. The rehabilitation or 8 demolition of the structure to be comp ted within fifteen (15) days after the date of the Council 9 Hearing; and 10 I 11 WHEREAS, a hearing was hel before the Saint Paul City Council on Wednesday, October 12 12, 1994 �I 13 and the testimony and evidence inclu ng the action taken by the Legislative Hearing Officer was 14 considered by the Council; now theref re 15 16 BE IT RESOLVED, that basel I upon the testimony and evidence presented at the above 17 referenced public hearings, the Saint ul City Council hereby adopts the following Findings and 18 Order concerning the Subject Propert at 1543 Dale Street North: 19 20 1. That the Subject Prope y comprises a nuisance condition as defined in Saint Paul 21 Legislative Code, Chap r 45. 22 I 23 2. That the costs of demol tion and removal of this building(s) is estimated to exceed 24 three thousand dollars ( 3,000.00). 25 26 3. That there now exists d has existed multiple Housing or Building code violations at 27 the Subject Property. I 28 29 4. That an Order to Abat Nuisance Building(s) was sent to the then known responsible 30 parties to conect the d ficiencies or to demolish and remove the building(s). 31 32 5. That the deficiencies sing this nuisance condition have not been conected. 33 � 34 6. That Public Health has Iposted a placard on the Subject Property which declares it to 35 be a nuisance conditio subject to demolition. 36 37 7. That this building has I een routinely monitored by the Vacant/Nuisance Buildings 38 Code Enforcement Pro ram. 39 40 8. That the known intere ed parties and owners are as previously stated in this 41 resolution and that the otification requirements of Chapter 45 have been fulfilled. 42 43 I ORDER 44 I 45 The Saint Paul City Council reby makes the following order: 46 94-�S�S p.���3 1 l. The above referenced interested r responsible parties shall make the Subject Property safe 2 and not detrimental to the publi peace, health, safety and welfare and remove its blighting 3 influence on the community by habilitating this structure and conecting all deficiencies as 4 prescribed in the above referen Order to Abate Nuisance Building(s) in accordance with 5 all applicable codes and ordinan s, � in the alternative by demolishing and removing the 6 structure in accordance with all pplicable codes and ordinances. The rehabilitation or 7 demolition and removal of the s cture must be completed within fifteen (15) days after the 8 date of the Council Hearing. 9 10 2. If the above corrective action is ot completed within this period of time the City of Saint 11 Paul, Public Health, Housing C e Enforcement Secdon is hereby authorized to take 12 whatever steps are necessary to emolish and remove this structure, fill the site and charge 13 the costs incuned against the Su ject Property pursuant to the provisions of Chapter 45 of 14 the Saint Paul Legislative Code. 15 16 3. In the event the building is to b demolish�l and removed by the City of Saint Paul, all 17 personal property or fixtures of y kind which interfere with the demolition and removal 18 shall be removed from the pro y by the responsible parties by the end of this time period. 19 If all personal property is not re oved, it shall be considered to be abandoned and the City 20 of Saint Paul shall remove and spose of such property as provided by law. 21 22 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested 23 parties in accordance with Chap r 45 of the Saint Paul Legislative Code.
