WHEREAS, She Division of Parks and Recreation's annual Gus Macker 3-on-3
Basketball Tournament will be held on the streets in the City's lowertown area on
August 19 and 20, 1995, and;
WHEREAS, The area does not have adequate space to place food and beverage vendors
for the event, and;
WHEREAS, Agri Bank F C B Incorporated is willing to allow the City to use its 1ot
on the corner of Jackson and Sixth Streets for the Gus Macker Tournament as a£ood and
beverage vending area, and;
WHEREAS, Agri Bank F C B has asked the City to indemnify and hold them harmless,
during the use of their lot, now;
THEREFORE, the City Council of the City of Saint Paul agrees to indemnify and
hold harmless the Agri Bank F C B Incorporated, its officers and employees from all
suits, claims and actions of every character and description brought against the Agri
Bank F C B Incorporated for or on account of any injuries or damages received or
sustained by any party, parties, or property by any reason of any act of negligence or
omission of said City, its contractors, agents or employees, or on account of any act
or omission o£ the City in its use and occupancy of the assigned premises or use of any
equipment of any kind belonging to Agri Bank F C B Incorporated, subject to the limits
of Minnesota Statute 466.

the Gus Macker 3-on-3 Basketball Tournament to take place in Lowertown on August 19 & 20.
AgriBank is wil1ing to let the City use their parking lot on 6th and Jackson in exchange
for a sponsorship and a hold-harmless resolution.
