4 WHEREAS, Metropolitan Council W stewater Services (MCWS) has increased their 1995
5 charges for regional wastewater tr atment to the City of Saint Paul 8% over their 1994
6 charges; and
7
8 WHEREAS, The Department of Pub c Works has recorded a long term trend in reduced
9 water consumption, primarily du to conservation, which reduces the revenue generating
10 ability of the Sewer Fund; and
11
12 WHEREAS, State and Federal man ated environmental programs have been imposed upon
13 Saint Paul without accompanyin funds; and
14
15 WHEREAS, There is a critical need or increased revenues and Retained Earnings in the
16 Sewer Service Enterprise Fund a evidenced by Standard and Poor's 1993 bond rating of
17 BBB+ with a negative outlook; an
18
19 WHEREAS, To stabilize rates in fut e years, which bond raters will look favorably on, rates
20 for 1996 through 1999 will have t increase approximately 8% to 10% per year; and
21
22 WHEREAS, The City Council Legis tive Task Force for Saint Paul Sewer Rate Relief recom-
23 mended a 1994 Storm Sewer Sys m Charge increase of 92% to correct the imbalance of
24 the Storm Sewer System Charge ot producing enough revenue to cover the storm sewer
25 system costs; and

27 WHEREAS, The City Council adopt d a 1994 Storm Sewer System Charge increase of 17% to
28 initiate a correction of this imba ance; and
29
30 WHEREAS, The City has requeste the MCWS to recalculate our flow based on average
31 rainfall (a spending reduction $3 0,000) and to eliminate interceptor reconveyance
32 charges until an agreement is r ched (a further reduction of $308,000); and

34 WHEREAS, The Department of Pu lic Works will review the costs and benefits of consolid-
35 ating the separate Sanitary Sew r System Charge and the separate Storm Sewer System
36 Charge on the Water Utility Bili ng System and thereby eliminating the Storm Sewer
37 System Charge annual billing; nd

39 WHEREAS, The Department of P lic Works shall form a partnership with the business and
40 citizen communities to address he steadily increasing charges from the MCWS; and
41
42 WHEREAS, The Mayor will form task force to study the rate structures and billing
43 procedures of the Sanitary Sew r System Charge and the Storm Sewer System Charge,
44 that will make recommendation to the City Council before the 1996 Budget is approved;

46 WHEREAS, Sanitary Sewer System ate increases in past years have been held low
47 through the use of Retained Earn gs; and

49 WHEREAS, Sanitary Sewer System harges pay the cost of operation, maintenance and
50 equipment replacement of the se age disposal system, including the principal and
51 interest on bonds sold for system nstruction and for paying Saint Paul's share of the
52 Metropolitan Council Wastewater ervices annual budget as provided in Chapter 473,
53 Minnesota Statutes, and in accord nce with the provisions of the Clean Water Act; and

55 WHEREAS, The proposed 1995 Bud t will result in anticipated expenditures, credits and
56 financing as follows:

97 Now, therefore, be it RESOLVED, t at pursuant to Section 77.02 of the Saint Paul Legislative
9� Code pertaining to Sanitary Se er System Charges and upon the recommendation of
99 City Administration, the Counci of the City of Saint Paul does hereby establish the
100 amount and basis for Sanitary wer System Charges to be levied and collected effective
101 January 1, 1995 through Decem er 31, 1995:

103 $2.21 per 100 cubic f t for the first 100,000 cubic feet; and
104 $2.19 per 100 cubic f t for the next 400,000 cubic feet; and
105 $2.13 per 100 cubic f t after 500,000 cubic feet.

135 than the amount of water cons med during the quarter consisting of the first three
136 months prior to the first billing of the year, except for those dwellings assessed
137 minimum charges; and

139 Be it FURTHER RESOLVED, th the Sanitary Sewer System Charges for all other
140 properties, regardless of the siz of the water meter, shall be based on actual water
141 consumption for each billing p riod; and

159 WHEREAS, The City of Saint Paul ursuant to Chapter 14, Article 19, First Special Session,
160 Laws of Minnesota, 1985, and al other laws particularly Minnesota Statutes, Section
161 444.075 and applicable charter p ovisions enacted an Ordinance (Ord. No. 17359, 6-3-86)
162 establishing a Storm Sewer Syst m Charge for the purpose of paying the cost of
163 construction, reconstruction, re air, enlargement and improvements necessitated by
164 the separation of the combined s wer system and for the maintenance, operation and
165 use of the separated storm sewe system; and ;

167 WHEREAS, The Storm Sewer Sys m Charge shall be based on a parcel's anticipated
168 contribution of stormwater runo to the storm sewer system, which is a function of the
169 parcel's size and its land use; a d

171 WHEREAS, The Storm Sewer Syst m Charge Ordinance provides that the City Council may
172 from time to time, by resolution stablish Storm Sewer System Charge rates for the
173 various land use classifications hich will be based upon data provided by the
174 Department of Public Works; an

177 jeopardize the City's ability to c ply with the National Pollutant Discharge Elimination
178 System (NPDES) permit for Sto water management;
