WHEREAS, the City of Saint Paul has e acted Chapter 293 of its Legislative Code
pertaining to the regulation of noise-
and
WHEREAS said Chapter permits the gr ting of an exemption or variance from such
regulation upon a determination of u easonable hardship upon the community or
applicant;
and
WHEREAS, the Department of Public Wo I s has applied for a variance from sound level
restrictions from October 10, 1994 t ough Mav 1, 1995 for a public work referred to as
Davern Outlet "B" Combined Sewer Se ation Pro'ect, located at Davern Street
immediatelv north of St. Paul Avenue;

WHEREAS, the City Council conducted public hearingSOn said matter on October 5,/�.1994,
now, therefore be it
RESOLVED, that the City Council here grants to the Department of Public Works and its
agent or contractor a variance from e requirements of Chapter 293 from October 10,
1994 through Mav 1, 1995 with the fo owing conditions: ,�•_..-_
1) Variance shall be granted rom 6:00 �'t�o �p.m.
2) Any source of noise opera 'ng between �'p.m. and 6:00 a.m. shall not
exceed a L10 noise level 65 dBA measured at a point of human activity
which is nearest the nois source and which is in a noise receptor Class II
as described in Sec. 293. , Noise Source Limitations.
3) Most higher noise level w k will be performed during daylight hours.
4) Ventilation equipment, ge rators, compressors and other similar equipment
will be enclosed if possi e and/or provided with the best available noise

Description of Variance:
Location: On Dav rn Street immediately North of St. Paul Avenue
� Noise Source: Constru tion of a storm sewer shaft/tunnel in preparation for sewer
project onstruction. Noise sources are expected to be from
support quipment needed for underground work on storm sewer
tunnels nd drop shafts. Equipment such as a crane for raising and
lowerin men, equipment and materials, a generator, ventilation
units, nd air compressor for power and ventilation for
undergr und work.

hours. uipment that may operate for extended periods of time
will be e closed if possible and/or be equipped with available noise
abateme devices.
The vari ce is being requested from October 10, 1994 to July l,
1995. D ring this period work can be expected to often occur 24
hours pe day, including weekends. However, there may be days
when w rk will not occur 24 hours per day. This will be
depende on the contractor and meeting the construction deadline.
This wor must be completed on or before the date indicated so
that the 1 95 sewer projects can begin and be completed in a timely
manner.

St. Paul Avenue. The variance with conditior�s is only for construction work in
said project from October lU, 1994 through May 1, 1995. Noise source will be
support equipment for underground work.
Resolution includes recommended variance conditzon� from LIEP EnvironMental Health.
ADVANTAGES IF APPROVED:
Granting �r the variance will alloti� the contractor perforniing in said project to work
24 hours per day. Majority of work will be done underground in tunnels. This will
allow for completion of the projec� so that other sewer pr•ojects that are planned
for the summer of 1995 can be completed.
DISADVANTAGES IF APPROVED:
Residents living near the project will be exposed to daytime and nighttime noise
that is greater than current background noise levels.
DISADVANTAGES IF NOT APPROVED:
Violations of Chapter 293 (St. Paul Noise Ordinance) would likely occur if variance
is not granfied. If underground work is not allowed to occur 24 hours per day, the
project could not be completed by the date indicated. This would result in delays
in the start of other Sewer Projects scheduled to begin in the summer of 1995.
