WHEREAS, the City of Saint Paul ha enacted Chapter 293 of its Legislative Code
pertaining to the regulation of no se;
and
WHEREAS, said Chapter permits the ranting of an exemption or variance from such
regulation upon a determination of unreasonable hardship upon the community or
appl icant ; ���
and
WHEREAS, the Department of Public orks has a lied for a variance from sound level
restrictions from October 10, 1994 through 1 1995 for a public work referred to as
Davern Outlet "B" Combined Sewer S aration Pro'ect, located at Stewart Street from
Davern to Mavnard Drive;
and

WHEREAS, the City Council conducte �public hearin�on said matter on October 5/ 1994,
now, therefore be it � ��

RESOLVED, that the City Co cil he grants to the Department of Public Works and its
agent or contrac r a variance fro the requirements of Chapter 293 from October 10, �
1994 through 1 1995 with the following conditions: �_ _� �,�;,,
1) Variance shall be grant d from 6:00 �� to� �--9�A–p:m-.
2) Any source of noise ope ating between ���II=�zii and 6:00 a.m. shall not
exceed a L10 noise leve of 65 dBA meas7.�red at a point of human activity
which is nearest the no se source and whicYi is in a noise receptor Class II
as described in Sec. 29 .09, Noise Source Limitations.
3) Most higher noise level work will be performed during daylight hours.
4) Ventilation equipment, enerators, compressors and other similar equipment
will be enclosed if pos ible and/or provided with the best available noise

5) Surface work shall be 1 mited to the hours of 6:00 �-�, to �3•3�-:-�@- p.m.

Description of Variance:
Location: On St wart Street from Davern to Maynard Drive
Noise Source: Const ction of a storm sewer shaft/tunnel in preparation for sewer
projec construction. Noise sources are ex�ected to be from
, suppo equipment needed for underground work on storm sewer
tunnel and drop shafts. Equipment such as a crane for raising and
lower' g men, equipment and materials, a generator, ventilation
units, and air compressor for power and ventilation for
under round work.

� Most igh noise level work will be performed during daytime
hours. Equipment that may operate for extended periods of time
will b enclosed if possible and/or be equipped with available noise
abate ent devices.
The v riance is being requested from October 10, 1994 to July 1,
1995. During this period work can be expected to often occur 24
hours er day, including weekends. However, there may be days
when work will not occur 24 hours per day. This will be
depen ent on the contractor and meeting the construction deadline.
This ork must be completed on or before the date indicated so
that th 1995 sewer projects can begin and be completed in a timely
mann .
