The meeting was called to order by hairman Glassman at 1:30 p.m. Chairman Glassman
welcomed the Appellants and explain the procedure, stating that what the Board does is
recommend action to the City Counc' . He also asked that the statements be brief and that
the Board was there as fellow citizen to help them in a fair manner.

The discussion by Mr. Lawson and m Halverson from FORCE contained items and
concerns regarding the following: e concerns for the basement have been addressed. The
duplex dwelling upstairs is in sad sh and will remain placazded. The upper unit will be
secured and not occupied. The cond tion of the front porch still needs to be addressed. The
condemnation will be lifted for the 1 wer unit and the upper unit will remain condemned.
There was also discussion about the eeded repairs to the electrical system.

Housing Code Enforcement stated th most of the repairs have been completed and that the
concerns about the rear addition is th t the problems may constitute a rodent infestation.
Discussion continued about the fact t Mr. Anderson is the property owner and that this
dwelling is not a rental unit.

interior and exterior lighting. Ms. G ldetsky stated that this is a family owned and occupied
building and that currently there are o problems with the exterior and interior lighting.
BOARD ACTION: Motion was ma by Winter to grant a variance for the required interior
and exterior lighting as long as the b ilding remains owner occupied. Seconded by Dunn.
Motion carried unanimously.

in bathrooms.
PROCEEDINGS: Testimony was pr sented by Edward Fischman regarding the required
GFCI outlets in the bathrooms. 7ac Breecher from Fire Prevention stated that these
GFCP s are necessary and that they e for the safety of the tenants to prevent electrical
shock. Mr. Fischman became very itated and refused to hear the explanations. The Boazd
stated what their policy is for grantin variances and that they do not grant variances when
the items relate to safety of the tenan s/occupants.

the exterior trim.
PROCEEDINGS: Testimony was pr sented by William Hite concerning the required
painting of the exterior of the buildin . Mr. Hite stated that last year the lowest level
exterior trim was painted at a cost of 1,000.00; this year the first floor is scheduled to be
painted at an estimated cost of $1,5 .00, Mr. Hite is requesting that the following schedule
be approved by the Board to comple the remaining painting needs. The second floor would
be painted in the year 1995 and the ird floor in the year 1996. Mr. Hite also stated that
there are no problems with lead paint
BOARD ACTION: Motion was mad I by Dunn to grant an extension of time to 1996 to
complete the required exterior trim p'nting. The time schedule is that the first floor will be
complete in 1994, second floor comp ted in 1995 and the third floor will be completed in
1996. Seconded by Winter. Motion 'ed unanimously.

SUBJF�CT: Appellant is requesting a variance for the required Vacant Building Registration
and fee.
PROCEIDINGS: Testimony was p ented by Mr. A. J. Rocklitz regarding the required
Vacant Building Registration and the ee. Discussion was long and Mr. Rocklitz became
extremely agitated. The history of th property was discussed by the Board and Harold
Robinson from the Vacant Buildings rogram. The issue of lead paint, permits and problems
with NSP were discussed. This buii ng has been boazded for two years. Mr. Rocklitz
states that he can do nothing to bring e house into compliance until the vacant building
designation has been lifted. There co tinues to be problems with lead paint and the ground
surrounding the house contains lead.

PROCEEDINGS: Mr. Rocklitz con ued to be agitated and asked to be put on record that
he objects. The Board stated the r n for the Vacant Building fees and the costs associated
with monitoring a vacant building. r. Rocklitz continued to object.

SUBJECT: Appellant is requesting a variance for the required Vacant Building Registration
and fee.
PROCEEDINGS: Testimony was pr sented by Gordon Schwarz regarding this vacant
building. This building was posted a a vacant building 7anuary of 1994. Mr. Schwarz
purchased the property in April of 1 4 and was unaware that this was a Registered Vacant
Building. The house is cunently be' g rehabilitated and remains unoccupied. Mr. Schwarz
applied for a loan to complete the re 'rs and has been approved, the repairs will be
complete by November 30, 1994 and will be homesteaded by Mr. Schwarz at that time.
Carrolyn Shephard from the Vacant uildings Programs agreed to a 60 day extension of time
to pay the Vacant Building Registrati n fee.
BOARD ACI'ION: Motion made by Winter to grant an extension of time until November
30, 1994 to pay the Vacant Building egistration fee. This fee will be waived at that time
with the condition that the rehabilitati n on the building is completed. Seconded by Dunn.

he purchased in November of 1992. . Dimond is in the process of rehabilitating this
building and has in years past paid th required Vacant Building Registration fee. Mr.

Dimond is requesting that this fee be aived because the rehabilitation on this building will
be complete by spring of 1995. Bef e and after pictures of the building were distributed.
Harold Robinson from the Vacant B ldings Program stated that the property is well
maintained and that the code requires that this building remain a Registered Vacant Building
until the Code Compliance Inspectio has been signed off. The Board discussed concerns
regarding the property. Chuck Votel Program Manager of Housing Code Enforcement
Programs stated that Mr. Dimond is ehabilitating the buildings over and above what the
code requires and would not be oppo ed to waving the fee with the condition that the
rehabilitation is complete by spring o 1995.
BOARD ACI'ION: Motion made by Winter to waive the Vacant Building Registration fee
with the condition that the rehabilita n of this building is completed by April 15, 1995 and
that the City will continue to inspect e property and that no violations exist. Seconded by
Dunn. Motion carried unanimously.

PROCEIDINGS: Testimony was pr sented by Lucille Widing. Ms. Widing distributed
pictures. The damaged that was cau to the property was due to the fact that the last
renter was overdue in paying rent, pipes froze causing damage and Ms. Widing was not
allowed into the dwelling by the Poli . This file was opened 7uly 13, 1994. Testimony
was presented by Harold Robinson m the Vacant Bulidings Program. Mr. Robinson
stated that progress is being made on the repairs. Ms. Widing stated that the repairs will be
complete by October 1, 1994.
