Claimant Rickey Suggs wastraveling southbound on Chatsworth at approximately 25 miles per hour, at approximately 1:00 a.m. Police Ofticer Karhleen Liebgott had just stopped at a stop sign on Iglehart; she had just been alerted by police radio to the possible presence of a crime suspect in the area and had therefore tumed off her squad's headlights. Officer Liebgott laoked to the north but failed to see the Suggs vehicle approaching, and proceeded into the intersection. The squad car collided with the right front fender of the Suggs vehicle and the force of impact caused the rear of the squad to hit the rear of the Suggs vehicle as weil. There is no indication of fault on the part of Mr. Sug;s for the accident. Mr. Suggs did not have insurance on his vehicle, and claims it was totalled as a result of the accident. Mr. Suggs is now 27 years old, unmarried and is the father of three sons. At the time of the accident he was employed at J.L. Industries doing heavy cabinet packing work. He is currently doing lighter assembly work for the same employer, and claims the accident restricted his ability to do the heavier work. He was off work nearty three months. He claims past wage loss of $3,500, and his vocational consultant predicts future wage toss of approximately $5,000 annually. Mr. Suggs claims injuries to his left knee, low back, neck, right shoulder and wntinuing headaches as a result of the accident. He has incuned over $4,600 in medical expenses. His physician issued a written opinion that Mr. Suggs has sustained a 20% whole body impairment and issued liftin and bending restrictions. The IME physician retained by the City does not believe the injuries were permanent; however, while there is some evidence of prior knee strain, there is no evidence of other prior injury. This case was set for a summary jury trial on July 20, 1995, and for a subsequent jury trial September 12, 1495. Before the summazy jury uial, tUe parties agreed to a settlement of all claims for a total payment of $10,200 by the CiTy of St. Paul. This settlement will include a release signed by Mr. Suggs, releasing the City from any obligation to pay subrogation claims by any of his medical providers. Given the liability issues and the extent of injuries and potential wage loss, this office recommends approval.
