This property is legally described as follows, to wit: 5 6 7 Lot 21, Geo. H. Schickler's ddition to the City of St. Paul, Ramsey County, 8 Minnesota. 9 10 11 WHEREAS, based upon the ords in the Ramsey County Recorder's Office and 12 information obtained by Saint Paul blic Health on or before July 18, 1994, the following are the 13 now known interested or responsible parties for the Subject Property: Joyce M. Boehme, 188 14 Mainzer Street, West St. Paul, MN 5118-1530; Brenda Gullickson, 2039 Butler Avenue, South 15 St.Paul, MN 55075. 16 17 WHEREAS, Saint Paul Publi Health has served in accordance with the provisions of 18 Chapter 45 of the Saint Paul Legisla ve Code an order identified as an"Order to Abate Nuisance 19 Building(s)" dated July 12, 1994; an 20 21 WHEREAS, this order infor ed the then known interested or responsible parties that the 22 structure located on the Subject Pro rty is a nuisance building(s) pursuant to Chapter 45; and 23 24 WHEREAS, this order infor ed the interested or responsible parties that they must repair or 25 demolish the structure located on the'Subject Property by August 11, 1994; and 26 27 28 WHEREAS, the enforcement fficer has posted a placard on the Subject Property declaring 29 this building(s) to constitute a nuisan condition; subject to demolition; and 30 31 32 WHEREAS, this nuisance co dition has not been conected and Saint Paul Public Health 33 requested that the City Clerk schedu public hearings before the Legislative Hearing Officer of the 34 City Council and the Saint Paul City Council; and 35 36 37 WHEREAS, the interested an responsible parties have been served notice in accordance 38 with the provisions of Chapter 45 of he Saint Paul Legislative Code, of the time, date, place and 39 purpose of the public hearings; and 40 � � q � - ►� �8 1 2 3 WHEREAS, a hearing was h ld before the Legislative Hearing Officer of the Saint Paul City 4 Council on Tuesday, September 20, 994 to hear testimony and evidence, and after receiving 5 testimony and evidence, made the r mmendation to approve the request to order the interested or 6 responsible parties to make the Subj t Property safe and not detrimental to the public peace, health, 7 safety and welfare and remove its bl hting influence on the community by rehabilitating this 8 structure in accordance with all appl ble codes and ordinances, or in the alternative by 9 demolishing and removing the struct re in accordance with all applicable codes and ordinances. 10 The rehabilitation ''�-of e structure to be completed within ��{�3}days after the i� date of the Council Hearing; and � h � h u ,,.� .,� e �� �.}.,, � j �� 1 13 14 WHEREAS, a hearing was h ld before the Saint Paul City Council on Wednesday, 15 September 28, 1994 and the testimo and evidence including the action taken by the Legislative 16 Hearing Officer was considered by e Council; now therefore 17 18 19 BE IT RESOLVED, that ba upon the testimony and evidence presented at the above 20 referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and 21 Order concerning the Subject Prope at 396 Edmund Avenue: 22 23 24 1. That the Subject Pro y comprises a nuisance condition as defined in Saint Paul 25 Legislative Code, Cha ter 45. 26 27 2. That the costs of dem lition and removal of this building(s) is estimated to exceed 28 three thousand dollars $3,000.00). 29 30 3. That there now exists d has existed multiple Housing or Building code violations at 31 the Subject Property. 32 33 4. That an Order to Aba Nuisance Building(s) was sent to the then known responsible 34 parties to conect the ficiencies or to demolish and remove the building(s). 35 36 5. That the deficiencies using this nuisance condition have not been conected. 37 38 6. That Public Health ha posted a placard on the Subject Property which declazes it to 39 be a nuisance conditio subject to demolition. 40 41 7. T'hat this building has een routinely monitored by the Vacant/Nuisance Buildings 42 Code Enforcement Pr ram. 43 44 8. That the known intere ed parties and owners are as previously stated in this 45 resolution and that the otificadon requirements of Chapter 45 have been fulfilled. 46 . . � � . q4 - ►�408 1 . ORDER 2 3 The Saint Paul City Council ereby makes the following order: 4 5 1. The above referenced interes or responsible parties shall make the Subject Property safe 6 and not detrimental to the pu lic peace, health, safety and welfare and remove its blighting 7 influence on the community rehabilitating this structure and correcting a11 deficiencies as 8 prescribed in the above refer ced Order to Abate Nuisance Building(s) in accordance with 9 a11 applicable codes and ordi ces, or in the alternative by demolishing and removing the 10 structure in accordance with 1 applicable codes and ordinances. If the above corrective action is not completed within this period of time the City of Saint 15 Paul, Public Health, Housing Code Enforcement Section is hereby authorized to take 16 whatever steps aze necessary o demolish and remove this structure, fill the site and charge 17 the costs incuned against the ubject Property pursuant to the provisions of Chapter 45 of 18 the Saint Paul Legislative C e. 19 20 3. In the event the building is to be demolished and removed by the City of Saint Paul, all 21 personal property or fixtures f any kind which interfere with the demolition and removal 22 shall be removed from the pr perty by the responsible parties by the end of this time period. 23 If all personal property is not removed, it shall be considered to be abandoned and the City 24 of Saint Paul shall remove an dispose of such property as provided by law. 25 26 4. It is further ordered, that a c y of this resolution be mailed to the owners and interested 27 parties in accordance with C pter 45 of the Saint Paul Legislative Code.
