1 WHEREAS, Saint Paul Pub c Health has requested the City Council to hold public hearings G
2 to consider the advisability and n ssity of ordering the repair or wrecking and removal of a two
3 story wood frame dwelling located n property hereinafter refened to as the "Subject Property" and
4 commonly known as 560 Burgess S eet. This property is legally described as follows, to wit:

6 Lot 1, Block 7, Foundry Ad ition to St. Paul.

8 WHEREAS, based upon the records in the Ramsey County Recorder's Office and
9 information obtained by Saint Paul blic Health on or before July 15, 1994, the following are the
10 now known interested or responsibl parties for the Subject Property: Fleet Finance Corp. aka Fleet
11 Industrial Loan Company of MN, I c. , 2626 82nd Street East, Suite 100, Bloomington, MN 55425

14 WHEREAS, Saint Paul Pub c Health has served in accordance with the provisions of
15 Chapter 45 of the Saint Paul Legisl tive Code an order identified as an "Order to Abate Nuisance
16 Building(s)" dated July 12, 1994; d

18 WHEREAS, this order infor ed the then known interested or responsible parties that the
19 structure located on the Subject Pro rty is a nuisance building(s) pursuant to Chapter 45; and
20
21 WHEREAS, this order infor etl the interesterl or responsible parties that they must repair or
22 demolish the structure located on th Subject Property by August 1l, 1994; and
23
24 WHEREAS, the enforcemen officer has posted a placard on the Subject Property declaring
25 this building(s) to constitute a nui ce condition; subject to demolition; and
26
27 WHEREAS, this nuisance ndition has not been conected and Saint Paul Public Health
28 requested that the City Clerk sched le public hearings before the Legislative Hearing Officer of the
29 City Council and the Saint Paul Cit Council; and

31 WHEREAS, the interested d responsible parties have been served notice in accordance
32 with the provisions of Chapter 45 o the Saint Paul Legislative Code, of the time, date, place and
33 purpose of the public hearings; and

35 WHEREAS, a hearing was eld before the Legislative Hearing Officer of the Saint Paul City

4 WHEREAS, a hearing was h ld before the Saint Paul City Council on Wednesday,
5 September 28, 1994 and the testimo y and evidence including the action taken by the Legislative
6 Hearing Officer was considered by e Council; now therefore

8 BE IT RESOLVED, that ba upon the testimony and evidence presented at the above
9 referenced public hearings, the Sain Paul City Council hereby adopts the following Findings and
10 Order concerning the Subject Prope y at 560 Burgess Street:

12 1. That the Subject Pro rty comprises a nuisance condition as defined in Saint Paul
13 Legislative Code, Ch ter 45.

15 2. That the costs of dem lition and removal of this building(s) is estimated to exceed
16 three thousand dollars ($3,000.00).

18 3. That there now exists I d has existed multiple Housing or Building code violations at
19 the Subject Property. '�

21 4. That an Order to Aba Nuisance Building(s) was sent to the then known responsible
22 parties to conect the eficiencies or to demolish and remove the building(s).

24 5. That the deficiencies using this nuisance condition have not been conected.

26 6. That Public Health ha posted a placard on the Subject Property which declares it to
27 be a nuisance conditi subject to demolition.

29 7. That this building has been routinely monitored by the VacandNuisance Buildings
30 Code Enforcement Pr gram.

32 8. That the known inter ted parties and owners are as previously stated in this
33 resolution and that th notification requirements of Chapter 45 have been fulfilled.

37 The Saint Paul City Council I ereby makes the following order:

39 1. The above referenced interes or responsible parties shall make the Subject Property safe
40 and not detrimental to the pu lic peace, health, safety and welfare and remove its blighting
41 influence on the community y rehabilitating this structure and correcting all deficiencies as
42 prescribed in the above refer nced Order to Abate Nuisance Building(s) in accordance with
43 all applicable codes and ordi ces, or in the alternative by demolishing and removing the
44 structure in accordance with 1 applicable codes and ordinances. The rehabilitation �—
45 '' of th structure must be completed within�f���days after the

1 2. If the above corrective actio is not completed within this period of time the City of Saint
2 Paul, Public Health, Housin Code Enforcement Section is hereby authorized to take
3 whatever steps are necessary to demolish and remove this structure, fill the site and charge
4 the costs incurred against th Subject Property pursuant to the provisions of Chapter 45 of
5 the Saint Paul Legislative C e.

7 3. In the event the building is t be demolished and removed by the City of Saint Paul, a11
8 personal property or fixtures of any kind which interfere with the demolition and removal
9 shall be removed from the p perty by the responsible parties by the end of this time period.
10 If all personal property is no removed, it shall be considered to be abandoned and the City
11 of Saint Paul sha11 remove d dispose of such property as provided by law.

13 4. It is further ordered, that a py of this resolution be mailed to the owners and interested
14 parties in accordance with C apter 45 of the Saint Paul Legisladve Code.
