1 RESOLVED, that upon the petition of The Travelers Insurance Company, per Finance
2 Department File No. 7 -1994, that part of Lot 1, Block 20, Roberts and Randalls Addition to St.
3 Paul, between Eight Street and Seventh Street, hereinafter described, is hereby vacated and
4 discontinued as public property.

6 The vacated area is described as follows:

8 The southwesterly 0.50 f )ot of the northeasterly 1.0 foot of lot 1, Block 20,
9 Roberts and Randalls Addition to St. Paul; and also,

11 The southeasterly 0.50 foot of East Seventh Street, (formerly East Eighth Street)
12 adjoining Lots 1, 2, 3, ar d that part of Lot 4, Block 20, Roberts and Randalls
13 Addition to St. Paul, lyir.g northeasterly of a line parallel to and 191.03 feet
14 southwesterly of the censer line of Minnesota Street and southwesterly of the
15 northeasterly line of saic Block 20, extended northwesterly which lies above
16 elevation 75 feet City Datum.

18 This vacation shall be subject to the following conditions:

20 1. That this vacation shall 5e subject to the terms and condition of Chapter 130,
21 codified March 1, 1981, Df the Saint Paul Legislative Code as amended.

23 2. That the petitioner's, their successors and assigns shall pay $500.00 as an
24 ad inistrative fee for this vacation which is due and payable within 60 days of the
25 4 e late of this -esolution.

27 3. That a permanent utility easement be retained within the vacated area of East
28 Sevent Street, as described above, to protect the interests of District Energy, St.
29 Paul, Inc. and District Cooling, St. Paul, Inc.

31 4. That the land described above is vacated to accommodate a building
32 encroachment and that upon removal, reconstruction, alteration demolition or
33 otherwise non - existence of the encroaching building the vacated land shall revert
34 to the City of Saint Pau: as street right -of -way without charge or cost to the City.

36 5. That the petitioner, its successors, and assigns, by acceptance of the terms and
37 conditions of this resolu lion agree to indemnify, defend and save harmless the
38 City of Saint Paul, its officers, and employees from all suits, actions, or claims
39 of any character brough; as a result of injuries or damages received or
40 sustained by any person persons, or property on account of this vacation or
41 petitioner's use of this property, including but not limited to a claim brought

1 ,. because of any act of omission, neglect, or misconduct of said petitioner or
2 because of any claims or liability arising from any violation of any law or
3 regulation made in accoi dance with the law, whether by the petitioner or any
4 of its agents or employees.

6 6. That the petitioner, its successors, and assigns, shall within 60 days of the
7 publication date of this resolution, file with the City Clerk and acceptance in
8 writing of the conditions of this resolution and shall within the period(s)
9 specified in the terms and conditions of this resolution, comply in all respects
10 with these terms and conditions.

a. The legal description of the property proposed to be

of Lot 1, Block 20, Roberts and Randalls Addition to the
City of Saint Paul.
b. The reason for the vacation and the intended use of the
property to be vacated.
The building commonly known as the Town Square Center
encroaches onto the easement for the widening of
Minnesota Street in the area the petitioner is asking to
be vacated.
