These vacations result from the fact that two corners • f the Town Square building encroach onto those streets. These pet tions will come before the City Council on June 22, 1994. We ould appreciate your support of these resolutions. Having taken title to he property in lieu of foreclosure, Travelers' goal is to cle up the many title problems associated with the property, and m• e on to the next step in marketing the property. This past Wednesday, I re•,eived copies of the proposed resolutions prepared by Dick McCann o the City. Copies of these resolutions are enclosed. You will s :e that paragraph 4 requires Travelers to enter into an agreement ith the Downtown Community Development Council ( "DCDC ") to esta•lish improvements that will restore the "pedestrian friendly ori= station of the streets surrounding Town Square ". This is an unus al requirement for a street vacation and is vague and will cause c•nfusion about how to comply. In fact, the management company for Town Square is presently working with DCDC in its m : tching funds program, to install planter boxes at all four entra ces of Town Square. Including such a condition in the Council esolutions will further cloud the title °14 -13(ao DOHERTY RUMBLE & BUTLER PROFESSIONAL ASSOCIATION Mr. Dave Thune June 17, 1994 Page 2 to the property and gay impede Travelers' marketing of the property.
