This property is legally 6 described as follows, to wit: 7 8 9 Lots 14 and 15, Block 2, P llips Addition. 10 11 12 WHEREAS, based upon the records in the Ramsey County Recorder's Office and 13 information obtained by Saint Paul 'ublic Health on or before June 23, 1994, the following are the 14 now known interested or responsibl parties for the Subject Property: Richard K. McNamara, 22855 15 Hayward Avenue, Forest Lake, M 55025 -8541; James C. Somers, 1361 Mississippi Street N.E., 16 Fridley, MN 55432; Tom Johnson 694 Burr Street, St. Paul, MN 55101. 17 18 19 WHEREAS, Saint Paul Pub c Health has served in accordance with the provisions of 20 Chapter 45 of the Saint Paul Legisl. tive Code an order identified as an "Order to Abate Nuisance 21 Building(s)" dated June 17, 1994; d 22 23 24 WHEREAS, this order infor ed the then known interested or responsible parties that the 25 structure located on the Subject Pro ■erty is a nuisance building(s) pursuant to Chapter 45; and 26 27 28 WHEREAS, this order infori ed the interested or responsible parties that they must repair or 29 demolish the structure located on th Subject Property by July 18, 1994; and 30 31 32 WHEREAS, the enforcemen officer has posted a placard on the Subject Property declaring 33 this building(s) to constitute a nuis. ce condition; subject to demolition; and 34 35 36 WHEREAS, this nuisance es dition has not been corrected and Saint Paul Public Health 37 requested that the City Clerk sched e public hearings before the Legislative Hearing Officer of the 38 City Council and the Saint Paul Cit Council; and 39 40 ORIGINAL 9'4 13 1 WHEREAS, the interested . d responsible parties have been served notice in accordance 2 with the provisions of Chapter 45 si the Saint Paul Legislative Code, of the time, date, place and 3 purpose of the public hearings; and 4 5 WHEREAS, a hearing was eld before the Legislative Hearing Officer of the Saint Paul City 6 Council on Tuesday, September 6, 1994 . to hear testimony and evidence, and after receiving 7 testimony and evidence, made the - ommendation to approve the request to order the interested or 8 responsible parties to make the Sub ect Property safe and not detrimental to the public peace, health, 9 safety and welfare and remove its ! ighting influence on the community by rehabilitating this 10 structure in accordance with all ap. icable codes and ordinances, or in the alternative by 11 demolishing and removing the stru • ure in accordance with all applicable codes and ordinances. 12 The rehabilitation or demolition of e structure to be completed within fifteen (15) days after the 13 date of the Council Hearing; and 14 15 WHEREAS, a hearing was eld before the Saint Paul City Council on Wednesday, 16 September 14, 1994 and the testim I y and evidence including the action taken by the Legislative 17 Hearing Officer was considered by he Council; now therefore 18 19 BE IT RESOLVED, that ba ed upon the testimony and evidence presented at the above 20 referenced public hearings, the Sai Paul City Council hereby adopts the following Findings and 21 Order concerning the Subject Prop: y at 547 Beaumont Street: 22 23 1. That the Subject Pro i erty comprises a nuisance condition as defined in Saint Paul 24 Legislative Code, Ch pter 45. 25 26 2. That the costs of de elition and removal of this building(s) is estimated to exceed 27 three thousand dollar ($3,000.00). 28 29 3. That there now exist and has existed multiple Housing or Building code violations at 30 the Subject Property. 31 32 4. That an Order to Ab. e Nuisance Building(s) was sent to the then known responsible 33 parties to correct the • eficiencies or to demolish and remove the building(s). 34 35 5. That the deficiencies ausing this nuisance condition have not been corrected. 36 37 6. That Public Health h. posted a placard on the Subject Property which declares it to 38 be a nuisance conditii n subject to demolition. 39 40 7. That this building ha been routinely monitored by the Vacant /Nuisance Buildings 41 Code Enforcement P .gram. 42 43 8. That the known inter: sted parties and owners are as previously stated in this 44 resolution and that the notification requirements of Chapter 45 have been fulfilled. 45 46 ORDER ORIGINAL 1 The Saint Paul City Council hereby makes the following order: 2 3 1. The above referenced interested or responsible parties shall make the Subject Property safe 4 and not detrimental to the ptblic peace, health, safety and welfare and remove its blighting 5 influence on the community by rehabilitating this structure and correcting all deficiencies as 6 prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with 7 all applicable codes and ordinances, or in the alternative by demolishing and removing the 8 structure in accordance with i all applicable codes and ordinances. The rehabilitation or 9 demolition and removal of tie structure must be completed within fifteen (15) days after the 10 date of the Council Hearing. 11 12 2. If the above corrective action is not completed within this period of time the City of Saint 13 Paul, Public Health, Housin; Code Enforcement Section is hereby authorized to take 14 whatever steps are necessary, to demolish and remove this structure, fill the site and charge 15 the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of 16 the Saint Paul Legislative Code. 17 18 3. In the event the building is b be demolished and removed by the City of Saint Paul, all 19 personal property or fixtures of any kind which interfere with the demolition and removal 20 shall be removed from the property by the responsible parties by the end of this time period. 21 If all personal property is nct removed, it shall be considered to be abandoned and the City 22 of Saint Paul shall remove and dispose of such property as provided by law. 23 24 4. It is further ordered, that a Lopy of this resolution be mailed to the owners and interested 25 parties in accordance with chapter 45 of the Saint Paul Legislative Code. Public Health has issued an order to the then known responsible parties to elimina .e this nuisance condition by correcting the deficiencies or by razing and removing this building(s). Inasmuch as this Order to Abate has inot been complied with the nuisance condition remains unabated, the community continues to suffer the blighting influence of this property. It is the recommendation of Public Health that the City Council pass a resolution ordering the responsible parties to either repair, cr demolish and remove this building in a timely manner, and failing that, authorize Public Health to proceed to demolition and removal, and to assess the costs incurred against the real es late as a special assessment to be collected in the same manner as taxes.
