25 Section 310.06(b) of the Sault Paul Legislative Code is hereby amended to read as
26 follows:

28 "(b) Basis for action. Such adverse action may be based on one (1) or more of the
29 following reasons, which are in addition to any other reason specifically provided
30 by law or in these chapters:

32 (1) The license or permit was procured by misrepresentation of material facts,
33 fraud, deceit or bad fith.
34
35 (2) The applicant or one (1) acting in his or her behalf made oral or written
36 misstatements or misrepresentations of material facts in or accompanying
37 the application.

39 (3) The license was issued in violation of any of the provisions of the Zoning
40 Code, or the premises; which are licensed or which are to be licensed do
41 not comply with applicable health, housing, fire, zoning and building codes
42 and regulations.

44 (4) The license or permit was issued in violation of law, without authority, or
45 under a material mistake of fact.

47 (5) The licensee or applicant has failed to comply with any condition set forth
48 in the license, or set forth in the resolution granting or renewing the
49 license.

18 (7) The activities of the censee in the licensed activity created or have
19 created a serious da _er to the public health, safety or welfare, or the
20 licensee performs or as performed his or her work or activity in an unsafe
21 manner.

23 (8) The licensed busines '' or the way in which such business is operated,
24 maintains or permits onditions that unreasonably annoy, injure or
25 endanger the safety, ealth, morals, comfort or repose of any considerable
26 number of members i , f the public.

28 (9) Failure to keep side .lks or pedestrian ways reasonably free of snow and
29 ice as required under Chapter 114 of the Saint Paul Legislative Code.

31 (10) The licensee or appli ant has shown by past misconduct or unfair acts or
32 dealings: physical ab :e, assaults or violent actions done to others,
33 including, but not li ted to, actions meeting the definition of criminal
34 sexual conduct pursu. 1 t to Minnesota Statutes Sections 609.342 through
35 609.3451; sexual abus , physical abuse or maltreatment of a child as
36 defined in Minnesota ; tatutes Section 626.556, subdivisions 2 and 10e,
37 including, but not lim ted to, acts which constitute a violation of Minnesota
38 Statutes Sections 609. 12, subdivision 10; 609.321 through 609.3451; or
39 617.246; neglect or e • angerment of a child as defined in Minnesota
40 Statutes Section 626.5.7, subdivision 2; the manufacture, distribution, sale,
41 gift, delivery, transpo ation, exchange or barter of a controlled substance
42 as defined in Minnes • a Statutes Chapter 152; the possession of a
43 controlled substance . defined in Minnesota Statutes Chapter 152 in such
44 quantities or under ci cumstances giving rise to a reasonable inference that
45 the possession was fo the purpose of sale or distribution to others; or by
46 the abuse of alcohol • 1 other drugs, that such licensee or applicant is not a
47 person of the good m» ral character or fitness required to engage in a
48 licensed activity, busi ss or profession.

50 (11) The licensee or appli•.nt has materially changed or permitted a material
51 change in the design, onstruction or configuration of the licensed premises

1 without the prior approval of the city council in the case of Class III 9
2 licenses, the director in the case of Class II licenses, and the inspector in
3 the case of Class I licenses, or without first having obtained the proper
4 building permits from the city.

11 The terms "licensee" or "applicant' for the purpose of this section shall mean and
12 include any person who has any in erest, whether as a holder of more than five (5)
13 percent of the stock of a corporation, as a partner, or otherwise, in the premises or in
14 the business or activity which are 1: censed or proposed to be licensed.

16 With respect to any license for activities entitled to the protection of the First
17 Amendment, notwithstanding the faregoing provisions, neither the lack of good moral
18 character or fitness of the licensee or applicant nor the content of the protected speech
19 or matter shall be the basis for adverse action against the license or application."
