WHEREAS, pursuant to a joint powers agieement, the City of Saint Paul and County of
Ramsey have consolidated their public elections functions with the County assuming
responsibility for all of the ministerial processes attendant thereto; and
WHEREAS, on July 11, 1995 an organizarion entitled ACORN filed a petition pursuant to
the initiative process of the City Charter for the enactment of an ordinance regarding publicly
assisted business enterprises and their hiring and wage practices as mare particularly set forth
in the proposed ordinance attached hereto and made a part hereof; and
WI-IEREAS, the County election officials have reported in writing and on file with the City
Clerk a statement declaring that the ACORN perition has met the requisite number of voter
signatures to proceed on in the initiative process; nowtherefore be it
RESOLVED, that based on the statement of the County of Ramsey as to the sufficiency of
the signatures on the ACORN petition and on the recommendation of the City Clerk, the City
Council hereby declares the petition sufficient and the proposed ordinance properly before it
in accordance with the processes of Chapter 8 of the City Charter and will be further
considered as provided by said Charter.

Certificate of Sufficiency Regarding a Petition for an Ordinance.
On July 11, 1995, a Petition was submitted by an organization entitled ACORN, to Ramsey
County Election Bureau, for the enactment of an ordinance regarding publiciy assisted business
enferprises and their hiring and wage practices.
Ramsey County Election Bureau has determined that out of the 10,051 signatures submitted,
5,077 valid signatures were required. There were 5,470 valid signatures on the petition. This
certifies that the petition is deemed valid.
This certification is made pursuant to Chapter 8 of the Saint Paul City Charter.

ORDINANCE
Section 1. PURPOSE. The purpose of this ordinance is to maximize the benefits to
Saint Paul residents when the City of Saint Paul or the Port Authority of Saint Paul
provide financial suppprt to corporations by. (a) zequiring that corporations
receive public assistance pay their employees a wage high enough to allow t��em to
meet basic need5; and @) requiring that cOrporations who receive assisWnce create a
net increase in jobs Eor Saint Paui residents.
Section 2 APPLICABILI7'Y_ This ordinance applies ta any mrporation, partnership,
limiced liability cpmpany, or sole proprietorship that receives city or port authority
financial assistance in excess of $25,000, including any federal grant program
administered by the city or port authority, revenue bond Financing, planning
assistance, tax increment finartcing, ta�c levies, ta�c czedits or any other form of
assistance, if the purpose of the assistance is economic development or job growth.
This ordinance also applies to any contractors, subcontractors or leaseholders at the
subsidized sites.
Section 3. MINIMUM REQUIREMENTS. The assistance:ecipienk and ati af£ected
contractors, svbcontractors and leaseholders mvst meet Ehe following minimum
recjvirements: (a) produce a net increase in jobs held by city residents, as defined by
Chapter 27 of the Saint Paul Administrative Code, in the city within cwo years of
receiving the assistance; (b) pay its employees who work at sites in the city at least a
poverty level wage which on an annualized basis is equal to 100 percent of the
federal poverty level for a family of four; and (c) to the greatest extent feasible, Eiil all
employment openings wiEh unempIoyed or underemployed Saint Pavl residents
referred by a Community Hiring Hali. The minimum requirements in this section
are in addition to any other laws or requirements eliat are applicable to the extension
of the assistance.
Section 4. COMMUNITY HIRING HALL.. The DeparCment of Planning and:,
Economic Development shall approve one oz more mmmunity based, non�rofit
organizacions as Cosstmunity Hiring halls. Tlte department shall consider. rhe
following cziteria for approval: (a) the organi�ation has a membership base and an
established record ot conducting outreach in low income Saint Paul neighborhoods;
(b) the organization has a skills bank where residents can register for employment
and training programs; (c) the organization has a process established whereby an
employer can post job openings, and referrals can begin within a 24-hour period;
and (d) the governing board includes low income persons.
Section 5. COMPLIANCE REPORT AND PENALTIES. The Depaxtment of Planning
and Economic Development shall report to the council on whethex the assistance
recipient has met the assistance requirements of section 3(a) within two years oE
receipt of the assistance. The department shall report annually to the council on
whether the assistance zecipient is in compliance with the requirements of sxtions
3(b) and 3(c). If the councii finds that an assistance recipient has Eailed to comply
with sections 3(a) or 3(c), tlie muncil shall cancel die assistance and may require the
recipient ro repay the assistance to the city. If the assistance recipient fails to comply
with section 3(b), the recipient shall pay the city an amount equal to two times the
diffezence between the wage required under clause 3(b) and the wage actually paid,
but not exceeding the total amount of assistance. Any assistance recipient who fails
to meet the provisions of this ordinance is nok eligible For additional city assistance
for a period of ten (10) years from the daee of canceitauon. ._
Section 6. SEVERABILITY. IE any section or any portion of a secrion of this
ordinance is declared unconstitufional, invalid or inoperative, in whole or in part,
by any court of competent jurisdiction, the remaining sections and all portions not
dedared unconsHtuHonal, invalid or inopesative shall remain in fvll force or effect,
and no such determination shall invalidate Fhe remaining secfions or portions of
fhe sections of Yhis ordinance.
