Referred To Committee: Date RESOLVED, that upon the petition of 2305 Riverford Partnership, Multi - Clean, Inc., and Liquor Village, Inc, per Finance Depa -tment File No. 14 -1994, that part of the alley in Block 5, Saint Catherine Park, Ramsey County, Minnesota, bounded by, Ford Parkway, Mississippi River Boulevard, and Highland Parkway, hereinafter described, is hereby vacated and discontinued as public property. The vacated area is described as follows: All of the north -south all ey adjoining Lots 5 throught 12, Block 5, Saint Catherine Park, subject to widenin€ of Ford Parkway. This vacation shall be subject to the following conditions: 1. That this vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the Saint Paul Legislative Code as amended. 2. That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for this vacation which is due and payable within 60 days of the publication date of this resolution. 3. That the petitioner's, their successors and assigns shall dedicate a permanent easement, to the City, by recordable document, for public alley purposes, subject to the following conditio a. That the land t be dedicated for alley purposes is described as follows: The south 20 feet of the north 35 feet of Lot 5, Block 5, Saint Catherine ?ark; and also, That part of Lots 4 & 5, Block 5, Saint Catherine Park lying within the following described lines: Beginning at the intersection of the west line o said Lot 5 and the north line of the south 20 feet of the north 35 feet of said Lot 5, (also described as line "A "); thence easterly alc ng said north line, 30 feet to a point; thence northweste ply in a straight line to a point on the west line of said Lot 4, said point being 30 feet northerly of the intersection of the west line o said Lot 5 and said line "A" when measured along the west lines of said Lots 4 & 5; thence south along the west lines of said Lots 4 & 5 to the point of beginning. QRI1NAL 4. That the petitioner's thei successors and assigns shall apply for and receive a paving permit f om the Department of Public Works for the construction of said alley ! The petitioner's their successors and assigns shall pay all costs and expenses fo 'the construction of said alley.1 5. The petitioner's, their successors, and assigns shall construct a new drainage system in the remainder f the unvacated alley in said Block 5, and also in the new dedicated alley, and r permit from the Department of Public Works, and shall pay all costs and ex enses for the construction of said drainage system subject to the approval o Public Works Sewer Division. 6. The petitioner's, their su ' cessors and assigns shall apply for and receive a permit to abandon the existing c : tch basin in said vacated alley or take over all costs and and expense of said catc basin as a private responsibilty. 7. That the petitioner's, thei successors and assigns shall pay all costs and expenses for the relocation of exis i lighting feed cabinet and associated equipment, subject to NSP distributi.n relocation, also being subject to the approval of the Department of Public W rks. 8. That a permanent utility 1 - asement shall be retained within the vacated area to to protect the interest of 1 orthern States Power Company. 9. That a permanent utility asement shall be retained within the vacated area to protect the interest of C , ntinental Cablevision, Saint Paul, Inc. 11. That the petitioner, its s 'ccessors, and assigns, by acceptance of the terms and conditions of this resolut on agree to indemnify, defend and save harmless the City of Saint Paul, its off cers, and employees from all suits, actions, or claims of any character brought as a result of injuries or damages received or sustained by any person, • ersons, or property on account of this vacation or petitioner's use of this p 'sperty, including but not limited to a claim brought because of any act of o ssion, neglect, or misconduct of said petitioner or because of any claims or liability arising from any violation of any law or regulation made in accor ' ance with the law, whether by the petitioner or any of its agents or employe:.. 0 , " 12. That the petitioners, they' successors, and assigns, shall within 60 days of the publication date of this resolution, file with the City Clerk and acceptance in writing of the conditions of this resolution and shall within the period(s) specified in the terms and conditions of this resolution, comply in all respects with these terms and conditions.
