8 Whereas, Pursuant t• Minnesota Statutes, S462.357 and
9 S64.400 of the Legislati T Code, WOODLAND TERRACE INC. duly
10 petitioned to rezone 538 ilayton Avenue, Saint Paul, Minnesota,
11 being legally described - Lot 6, Block 4, Woodland Park Addition
12 from RT -2 to P -1 for the purpose of permitting reuse of the
13 property for off - street •=rking, the petition having been
14 certified by the Plannin• Division on March 11, 1994, as having
15 been consented to by at 1�-ast two - thirds of the owners of the
16 area of the property to •- rezoned, and further having been
17 consented to by at least 1 .7% of the owners of the property
18 situated within 100 feet the total contiguous property within
19 one year preceding the d. e of the petition; and

I am writing on behalf of Woodland errace Inc. regarding the rezoning of our vacant lot at 538
Dayton Ave. City Council voted on ay 25, 1994 to approve rezoning of this property from RT-
2 to.P -1 in order that we may build a ` ve car parking structure. We request that you schedule a
public hearing to consider re- zoning e property back to RT -2 from its current zoning of P -1.
The reason for this request is that ou immediate neighborhood is in a state of transition that is
affecting our plans for building a five ar garage. Currently, a historic single family home 'lies
between Woodland Terrace row hou es and our vacant lot. This house needs significant
restoration. In the past few weeks, a'. erious buyer for the house has emerged. The buyer is
interested in purchasing the house o if it can be moved to our vacant lot. Woodland Terrace is
very supportive the concept of mo 'ng the house and thereby swapping properties because it
benefits everyone in the neighborhoo : a historic structure in serious disrepair would be renovated
and re- positioned in a more compati . e location with the surrounding structures and our parking

structure would be contiguous to ou row house. We had a neighborhood meeting last night with
all the nearby property owners which included the neighbors who spoke against the initial re-
zoning request. There was unanimo . sentiment that the proposed scheme was beneficial to the
neighborhood. A copy of the petitio circulated at that meeting is attached.

The prospective buyers, Kathy Anderson and Jim Frazee, and I have had numerous phone
conversations and meetings with city staff in legal, planning, zoning, building and HPC in order to
understand the technical requirements for accomplishing our common goal. It is our
understanding that the house can not be moved until the fot is rezoned to residential. City staff
has informed us that it is possible to re -zone the property with your approval, but without starting
the entire re- zoning process over again with the normal lengthy petition and zoning review
•
process. The prospective buyers and Woodland Terrace have a strong desire to substantially
complete both projects this year. Shoald you agree to schedule this matter for public hearing and
subsequent readings, we will continue to prepare documents for city site plan, building and HPC
'review.
If the proposals for purchasing the ho ne or swapping the lots are terminated for any reason, we
Will ask at a scheduled reading that ycu remove our request for're- zoning. Woodland Terrace
would then construct garages per the currently approved plans.
We appreciate your prompt attention to consider our request to schedule a public hearing to re-
zone 538 Dayton Ave. to RT -2.

Subject: In consideration of a lot swap between the owners of
538 Dayton and 548 Dayton, requiring a zoning reversal.
I /We, the undersigned, support relocation of the vacant house
currently located at 548 Dayton, to the empty lot next it at 538
Dayton. It is our understanding that this could well facilitate
the immediate renovation of this house, which has remained vacant
for many years.
I /We would prefer the garages currently planned for construction
on 538 Dayton by Woodland Terrace, Inc. be built on the lot at
548 Dayton (which would be vacated once the house was moved to
the adjacent lot). Not only would this improve the look of the
block by avoiding the placement of a 5 car garage between two
single family homes, but it would also allow the garage owners to
have their parking adjacent to their property.
I /We understand that moving the house to the recently rezoned lot
would require a zoning change back to R2 from its P1 designation
(approved only last month by the Saint Paul City Council).
I /We support expedited handling of this zoning process, since
public hearings have already been held on the proposed garage and
the two lots in question are adjacent.

Attached is a 'letter from Woodland Terrace, Inc. requesting the City Council to rezone their
property at 538 Dayton Avenue to RT -2. Also attached is an ordinance which would accomplish
this rezoning.
The City Council approved rezoning his same, undeveloped parcel from RT -2 (townhouse
residential) to P -1 (parking) on June 25, 1994 following a public hearing. The Council gave final
approval of the ordinance rezoning tc P -1 on July 20, 1994 and the Heritage Preservation
Commission approved the design of . garage for the site on July 28, 1994. The intention of
Woodland Terrace was to build a five car garage for their nearby rowhouses.
In between the Woodland Terrace rowhouses at the corner of Dayton and Kent and their now
P -1 zoned lot at 538 Dayton is an apparently long vacant house at 548 Dayton Avenue situated
only a few feet from the Woodland Thrrace building. Apparently several parties interested in
buying and renovating the structure have decided otherwise because of the close proximity to
the rowhouse building. Now two people are interested in buying the house and essentially doing
a land swap with Woodland Terrace: the house would be moved to the adjacent lot at 538
Dayton and Woodland Terrace woulc build its garages on 548 Dayton. All parties involved have
agreed to this arrangement.

If this swap can be accomplished, the house would be moved to a new site with more space
around it and renovated and Woodland Terrace would have parking immediately adjacent to
their building. In order for this to ha.pen, 538 Dayton, just rezoned to P -1, needs to be rezoned
back to RT -2 in order to allow a residential use. Woodland Terrace could then build their
garage on 548 Dayton, even though it is zoned RT -2, because it is on a lot abutting their
residential use.
This solution is one that a number d neighbors have long preferred but seemed unfeasible
because of a lack of an interested purchaser. Planning staff also agrees that this solution is
significantly more preferable.
City staff have been working with all larties involved to expedite this process and make it
possible for Woodland Terrace to build their garages before the coming winter. The City
Attorney's Office has said that a letter from Woodland Terrace requesting that their property at
538 Dayton be rezoned back to RT -2 could be considered by the City Council as part of their
original rezoning application if it is promptly received and another public hearing is held. This
approach expedites the process by eli ninating the need for presenting another petition for
Planning Commission review and puHic hearing. Staff suggests setting a City Council public
hearing to consider the rezoning at the third reading on September 7, 1994.
Also attached are a petition by neighbors in support of the rezoning and a land use map
showing the area of the proposed rezoning. If any councilmembers would like a copy of the
