3 RESOLVED, that the Licensee, Clark Refining & Marketing, Inc. (License ID#
4 15851) for the premises located at 400 Dale Street, in Saint Paul is hereby ordered to
5 pay a fine of $200 for the violation of sale of tobacco products to a minor.

7 Said fine shall be paid tc the Office of License, Inspections and Environmental
8 Protection within thirty days of this resolution's adoption by the Saint Paul City Council
9 and the Mayor's signature.

11 This Resolution and the action taken above are based upon the facts contained in
12 the attached notice of complain;, dated April 18, 1994. The facts as outlined in this
13 letter are not contested by the licensee, as evidenced by the attached letter, received in
14 the Office of the City Attorney Dn July 22, 1994, signed by Patrick F. Heider, Attorney,
15 on behalf of the licensee. This action is also based 011 the circumstances and arguments
16 presented by and on behalf of the licensee during the Public Hearing.

Re: Cigarette sale to miner com•liance check operation summary
I have been an intern ,with LISP or ap :oxirnately four years. In that time I have
conducted numerous invest :gatto ' invol,- g various licensed facilities and activities.
On June 15, 1994 between the ho irs of 2:20 p.m. and 6:28 p.m., I accompanied Melissa
Jests, age fifteen (birth date 9 -23 78), to 1 eny -two licensed cigarette retail
establishments for the purpose of ' - --trg if such licensees would sell cigarettes to a
minor in violation of Section 324.47 of the Saint Paul Legislative Code and in violation
of Minn. Stat. § 609.685. Ms. Jen 's physical description is as follows: caucasian, 5'7",
blue eyes, shoulder length brown rair, wefght 135 pounds, braces on teeth. On the date
and time period of the "sting" ope ation Ms. Jents wore a tan striped t -shirt and jean
shorts. Ms. Jents wore little mak -: p.
On April 21, 1994 it was determin d that twenty -two licensed cigarette retail
establishments would be investiga d for compliance.
A random selection process was d rived in the following manner. A computer printout
was made by licensing staff person Linda Koran by randomly generating eighteen
establishments from the total list e licensees through the random computer function in
the licensing system. In addition f•ur other establishments were added as complaints
were received by this office makin the total number to be investigated at twenty -two.
The investigation procedure consis ed of sending the minor into respective listed
establishments attempting to purch se a pack of cigarettes. At no time did the minor

me of such sale and of which employee sold such (identification was made by name tag,
physical description, and by particu ar counter), I entered the establishment and identify
myself by showing my badge. I ex Rained that the sale of cigarettes to a minor was made
and that this act constituted a gros•! misdemeanor punishable of up to S500.00, and could
result in adverse action against the License or licenses held. I then asked for their name,
requiring them to spell it and recor' ed it in a copy of memorandum dated April 21, 1994
listing all the establishments to be I l vestisated. I recorded any other relevant comments
or information. If the employee or manager of the establishment voiced any kind of
objection, I responded in clear ter i s that due process would be afforded to them.
Receipts \v ere retained. The re., ipts a-d cigarettes are given to you in conjunction with
' this report in an envelope mark "Ciga ettes and Receipts from 6 -15-94 Compliance

Of the twenty -two establishment• investigated, nine (9) cigarette retailers did sell
cigarettes to said minor. The fol owing is a list of such licensees, the time of sale and
the name of the employee who r.nducted the sale in the order they «•ere randomly

Your letters of June 24 ani July 14, 1994 regarding the above have been
forwarded to me. Please be advised that Clark Refining & Marketing, Inc.
does not dispute the allegations contained in your June 24, 1994
correspondence. It is my understanding that a penalty hearing will take
place on August 17, 1994 before the City Council. Mr. Bob Jackson will
