Effective January 1, 1'94 the Legislature had enacted Minn. Stat. § 211A.12 which reads :s follows: "211A.12 CONTRIBU ION LIMITS. A candidate ay not accept aggregate contributions made or delivered •y an individual or committee in excess of $300 in an el:ction year for the office sought and $100 in other years; except that a candidate for an office whose terrtory has a population over 100,000 may not accept aggregate contributions made or delivered by an individual or committee in excess of $500 in an election year for the office sought and $100 in other years." Prior to this enactme't, state law had only regulated campaign financial reporting f.r candidates for local office. Now by statute, local governme t candidates are regulated as to the actual amounts that they rece've to finance their campaign. The legal and practica effect of this legislation is that local ordinances on the subje t, such as the City's Chapter 28, have been preempted and are void The enclosure, as you will note, adopts the above statute by -ference rather than actually setting out exact dollar amounts or' in what years various amounts of money can be contributed. We recommend this approach because, as state laws Ms. Molly O'Rourke May 17, 1994 Page 2 1 are often amended, to ' eference the specifics in an ordinance would require the City to in' ur the cost in money and time to update this section of the Code e.ch time that happens. We also call your att :ntion to the new dollar limitations set by this new state law as I ompared with the language of Chapter 28 as it now exists and appears in the stricken portion of the enclosure.
