1 WHEREAS, the City of S. ' t Paul, acting through and by its Department of Fire
2 and Safety Services, hereinafter th : "City ", desires to conduct various fire training
3 exercises at the property commonl known as 246 West Rose, Saint Paul, Minnesota; and
4
5 WHEREAS, the above des 4+ ibed property is owned in fee by the State of
6 Minnesota, hereinafter the "State", as a tax forfeited parcel and is subject to demolition,
7 as ordered by the Council of the • ty of Saint Paul in Council File No:94 -1071, by the
8 John Alexander Company of Minn apolis, MN, hereinafter the "Company"; and
9
10 WHEREAS; the City has p oposed to conduct a fire training exercise at the
11 subject property prior to the demo ition of the property and the State and the Company
12 have indicated willingness to acco + odate the City's proposal upon the signing of an
13 agreement between the City, the S ate and the Company, wherein the City will
14 indemnify, save and hold harmless j the State and the Company, from any and all claims
15 from third parties for damages or 1 juries arising directly or indirectly as a result of the
16 City's fire training exercise held at the subject property; NOW THEREFORE BE IT

18 RESOLVED, that the prop r officials of the City are hereby authorized and
19 directed to execute such an agree ent with the State and the Company for the purposes
20 of permitting fire training exercise at the property commonly known as 246 West Rose,
21 Saint Paul, Minnesota; AND BE FURTHER
22
23 RESOLVED, that a copy o said agreement shall be filed and kept as a record in
24 the Department of Finance and : agement Services of the City of Saint Paul.
