Smith, per Finance Dep , rtment File No. 13 -1994, that part of the alley in Block 1, Stinson's Boulevard Addition ,bound • d by Grand Avenue, Syndicate Street, Summit Avenue, Ayd Mill Road, hereinafter described, . hereby vacated and discontinued as public property. The vacated area is described a• follows: That part of the East -We .t Alley in Block 1, Stinson's Boulevard Addition that lies westerly of the south: rly extension across said alley of the east line of Lot 3, said Block 1 and also lies easterly of the following described line: Commencing at the southwest corner of • t 9, said Block 1, thence easterly along the south line of Lots 3 through 9, said Bl ck 1, 276.50 feet to the point of beginning of the line to be described; thence sou easterly 20.15 feet to a point on the north line of Lot 16, said Block 1, 278.83 f et easterly of the northwest corner of Lot 10, said Block 1 and there terminating. This vacation shall be subject to the following conditions: 1. That this vacation shall b - subject to the terms and condition of Chapter 130, codified March 1, 1981, I, the Saint Paul Legislative Code as amended. 2. That the petitioner's, the successors and assigns shall pay $500.00 as an administrative fee for thi • vacation which is due and payable within 60 days of the publication date of this r solution. 3. That the petitioners, thei successors, and assigns, by acceptance of the terms and conditions of this resolut' • n agree to indemnify, defend and save harmless the City of Sain Paul, its officers, and employees from all suits, actions, or claims of any characte brought as a result of injuries or damages received or sustained by any person, l ersons, or property on account of this vacation or petitioner's use of this pr . perty, including but not limited to a claim brought because of any act of o ssion, neglect, or misconduct of said petitioner or because of any claims or i iability arising from any violation of any law or regulation made in accor ance with the law, whether by the petitioner or any of its agents or employee 1 1 4.
