No other penalty applies. Recommendation by Assistlxnt City Attorney on behalf of client, Office of License Inspections and Environmental Protection (if any): Two weeks's suspension, with one week stayed for a period of 18 months, and compliance with the conditions specified in the Stipulation. Downward departure is based (1) on the fact of the similarity of this case with Wallace's Westsider Bar, and the penalty imposed in that case; (2) on the fact that the licensee has sought and will remain in a alcohol and drug treatment as long as he holds a license; and (3) on the fact that it appears he 14as not a drug dealer, using the licensed premises for the sale of drugs, but rather was principally a dependent user. Notice of Violation Q� -- I] STIPULATION OF FACTS On January 2, 1994, a search warrant was executed at the premises of the Starting Gate Bar. Dean O. Gubbrud was arrested by the police for possession of controlled substances, including cocaine and marijuana, discovered in a basement room of the bar which he used, and to which he had the keys and gave them to the police for the p rpose of the search. Those substances were determined to be cocaine and rijuana. As indicated in the police reports, the room also contained drug p. aphernalia. The foregoing violates state law, and furnish a basis for advers- action under Sections 310.06(b)(6), (7) and (10), and 409.06(c). In addition, gambling paraph: rnalia was found on the licensed premises. Undercover officers had previosly observed Gubbrud gambling on the licensed premises, and a pen register t ereafter placed on the bar telephone indicated calls in furtherance of such g. •ling. This violates Section 409.08(6) of the Saint Paul Legislative Code. he foregoing matters also constitute grounds for adverse action against al j the licenses held for that premises. The attached police reports c•rroborate the foregoing and are a part of the record upon which disciplinar action may be taken by the Council. The licensee does not contest these facts, and the facts contained in the police reports to the extent t ey prove the foregoing matters. The foregoing reports do not show, and the icensee does not admit to, the felony offense of sports bookmaking. The licensee does not contest the facts that show he was in possession of cocaine and marijuana as indicated above and in the police reports. Based on the foregoing, an the attached police reports, it is the recommendation of the licen -e office that the City Council impose a suspension of all licenses fora period of two weeks, of which one week would be stayed for a period of 18 m•nths. The recommendation of the license office is also that this license sha l be further conditioned for as long as Dean Gubbrud shall hold the licens:s for the sale of alcoholic beverages or have any interest in said license,lby the following express conditions: 1. Dean Gubbrud shall undergoldrug and alcohol assessment and treatment, if he has not already done so, a • shall cooperate fully in such assessment and treatment. 2. Dean Gubbrud, for as long as he shall hold these licenses or have any interest in such licenses, s all be an active and participating member of Alcoholics Anonymous for both alcohol and drug treatment, and shall attend weekly meetings of such organ'zation while he holds such licenses or has any interest in them. In the event that the Cit Council does not accept this case as an uncontested matter, and dire•ts that it be heard by an administrative law judge, neither party will, be bound by any of the agreements or representations herein. The target of the inve- tigation was a person identified as GUBBRUD, DEAN OTTO, d.���.b. 05/03/52. CRI stated that GUBBRUD owns the STARTING GATE BAR located at 2516 West Seventh Street, St. Paul and that GUBBRUD Iegularly conducts sports bookmaking at this location. Through the License 'vision of L.I.E.P., City of St. Paul I confirmed that GUBBR ei holds a current business license for 2516 West Seventh Street under the name G -RUD INC. and lists himself as president under licens- ID #19509. Based on the information furnished by the CRI, I, along with Special Agent WILLIAM', THOMPSON, Minnesota Department of Public Safety, Gambling Enfo• cement Division . did, on 10/14/93 enter the STARTING GATE BAR i an undercover capacity. z 0 0 0 - On 11/15/93 I obtaine. A District Court order from Ramsey County District Court for aut ority to install a pen register on 612-693 - 5911 and other telephs.ne numbers subscribed to the STARTING GATE BAR. The pen registe. was activated on 11/19/93. The first warrant was for DEAN GUBBRUD and he STARTING GATE BAR, 2516 West Seventh Street, St. Paul and tie second warrant for DEAN GUBBRUD and his residence, 1115 Elway •,.artment 402, St. Paul as well as two motor vehicles which register -d to GUBBRUD: 503 BAL, a 1985 Olds and 489 HZS, a 1983 AUDI. Both warrants were pres,nted to and signed by District Court Judge J. CAMPBELL on 12/31/91. At or about 1500 hrs., 01/02/94, executed search warrant on 2516 West Seventh Street. Assisting with the wa rant was: Lt. RON RYAN, Commander, SIU; Sergeant P. TREDAL, SI ; Sergeant G. KUEHL, SIU and Special Agent WILLIAM THOMPSON. Squad 426, Officer D. ABEL and Squad 450, Officer W. GILLET also assisted. When we entered, I obse GUBBRUD standing at the bar, talking to a customer. There wer= approximately 20 -30 customers present. I approached GUBBRUD ani identified myself and told him I was executing a search war ant and handed him a copy of the warrant. I then asked GUBBRUD ii he would ask the customers to leave so as to expedite the search and avoid any contamination of the search site. GUBBRUD compile.; and the patrons left. GUBBRUD identified the black case recovered from the basement as belonging to him but d -nied ownership of its contents. GUBBRUD stated he uses the b- sement area but denied knowledge of any suspect cocaine. GUBBRis did however identify the money recovered from the basement as we-kend bar receipts. • GUBBRUD was advised tha a search warrant would be executed at his residence and he provi•ed us with keys to his'apartment so as to make entry. After the cocaine was 1.cated I informed GUBBRUD that he was under arrest for possession o» controlled substance and felony gambling violation(s). I then advised GUBBRUD of miranda which he stated he understood. GUBBRUD then stated h: wanted an attorney present during any questioning. No furthe, questions were asked of GUBBRUD. Gubbrud, owner and operator of The Starting Gate, he wishes not to contest th... allegations of violations of his liquor license as set forth in your May 2, 1994 letter. Mr. Gubbrud has taken it upon self to complete an outpatient program at St. Paul Ramsey Hospital and he was suc essfully discharged on April 12, 1994 (see attached copy of a Certificate indicating c s mpletion of Chemical Dependency Program). Since his completion of the program, he 1 s been a participant in AA and has sought out a sponsor who I have met and talked with. The sponsor agrees that Mr. Gubbrud recognizes his problem which is the hardest p. and has sought out others to assist him in his recovery. His sponsor believes he has coo •'-rated, participated in AA since his outpatient discharge. There is no allegation that his pa .t chemical problem had affected his business. Mr. Gubbrud's record as a licens holder is exemplary as it pertains to compliance with the rules, regulations, and police calls that the City tests operators on. He has had no gi 1101 Mr. Philip B. Based on the above statements . d Mr. Gubbrud's record, we ask that the Council adopt the recommendation of the City ttomey for a one week closing and that he be given credit for an additional day that . the time the police came to his establishment they shut it down with the loss of $1,000- '1,500 of revenue and the removal of over 30 of his patrons from the establishment u em 3:00 p.m. for the remaining portion of the day. We believe this is an extreme burden for a small business owner.
