WHEREAS, the City of Saint Paul by • ocument no. 1567601 dated July 18, 1962, and
document no. 2021147 D ted October 19, 1978, acquired the use of Tax Forfeited
Land, for right -of -way pu • oses, described as Lots 3 & 4, Block 1, Stinson's
Boulevard Addition, fro 1 the State of Minnesota; and,
WHEREAS, Kowalski's Market locate. at 33 South Syndicate Street has requested the City to
release its interest in a p rt of this property for the purpose of a proposed
addition to its facilities o Syndicate Street; and
WHEREAS, The Department of Publ Works has reviewed and approved the request to
reconvey a part of said . is 3 & 4 to the State of Minnesota for subsequent
resale to Kowalski's Mar et.
THEREFORE BE IT RESOLVED, Th Council of the City of Saint Paul hereby authorizes the
proper City Officials to ecute an application of reconveyance of part of said
Lots 3 & 4 to the State •I Minnesota for subsequent resale to Kowalski's Market
to be administered by th. Housing and Redevelopment Authority of the City of
Saint Paul. Said proper is described as follows:

ORIGINAL That part of Lots 3 & 4, :lock 1, Stinson's Boulevard Addition that lies south of
the south line of the nor' 150.0 feet of said Lots and also lies westerly and
southerly of the followin_ described line:
Commencing at t southeast corner of said Lot 3; thence north 0 degrees
10 minutes 55 sec , nds west along the east line of said Lot 3 a distance of
28.35 feet to the .. int 5.0 feet, as measured at right angles to the westerly
line of a 1.0 foot . oncrete retaining wall, said point being the point of
beginning of the 11 e to be herein described; thence north 6 degrees 52
minutes 20 seco u. west parallel to said wall 29.49 feet; thence south 89

Kowalski's Market on Syndicate and Grand would like to expand its facilities on tax forfeited property
located to the north and adjacent to its stor*. Public Works has approved a release of its interest in p rt
of the tax forfeit parcel being used as right- cfway. The area of the tax forfeited parcel to be used for
Kowalski's addition must first be reconveyec to the State of Minnesota and subsequently conveyed to
Kowalski's through process administered by the Housing and Redevelopment Authority.

Vacation o part of the alley and
reconveya e of part of Lots 3 & 4, all
in Block 1, .tinson's Boulevard Add.
The Department of Public Wor s has completed its review of the above referenced
proposal. There are no objectio s to the vacation of the small piece of alley being
requested.
Approval of the reconveyance o part of Lots 3 and 4 shall be subject to the following
conditions:
1. Kowalski's shall submit a le ter to the Department of Public Work's for our records,
acknowledging that they are a are that the City is currently conducting an
Environmental Impact Study ( IS) on Ayd Mill Road and that the outcome of the EIS
may affect their site and/or thei proposed improvements. This letter should be sent to
my attention:

2. The City shall retain a mini um of five feet measured from the back (west side) of
the Ayd Mill Road retaining wal to accommodate the wall footings and for minimal
clearance to maintain and repai the wall. Therefore, the request needs to be modified
to allow for this minimal cleara ce with the wall and their survey must be amended
accordingly. The wall must be c -arly shown on the survey and a new line established
a minimum of five feet westerly .f said wall.
