94-1095 QRI6tNAL Council File # q Green Sheet # -V Lf 4'i/ 7 RESOLUTION CITY OF SAINT PAUL, MINNESOTA Presented By: L r rrtc/J6( Referred To: Committee: Date WHEREAS, Youth Express of the Saint Paul Area has requested the donation of scrap bikes from the Saint Paul Police Impound Lot, anc WHEREAS, the bikes requested have little or no value and will be repaired, rebuilt and resold by the Youth Express to stimulate economic development in poor and disadvantaged areas of Saint Paul, and WHEREAS, the Saint Paul Police Department and the City as a whole sees the aforesaid economic development has public purpose, and establishes another police- community partnership, and NOW, THEREFORE, BE IT RESOLVED, the Saint Paul Police Department is authorized to donate scrap bicycles from the Saint Paul Police Impound Lot. ' AS, the City has bic cles which have been declared as "scrap" by the City of Sain 'au d may be given away i ■ authorized by the Mayor and City Council, and EREAS, Youth Express as the ability to use the said "scrap" bicycles to stimulate economic development in poor and d sadvantaged areas of Saint Paul by reworking the bicycles which have been heretofore disposed • f as scrap metal into workable, salable bicycles to further the public purpose of Youth Expres and WHEREAS, the City sees the aforesaid economic development has public purpose, and now THEREFORE, be it resolv- • the two parties hereto do mutually agree as follows: 1. The City agrees to gi e bicycles to Youth Express as available. Youth Express may come to the Pol ce Impound Lot in Saint Paul to take possession of the bicycles on an availab e basis until August 1, 1995, at a time mutually agreeable to both parties. 2. Youth Express agrees to do the following: a. To pick up the bicycles as stated in paragraph 1, above. b. To use the bic cles for the purpose of economic development in poor and disadvantaged : eas of Saint Paul, by the repair and sale of said bicycles. c. To defend, hol • and save the City of Saint Paul harmless from any action, L liability or j ud : ment arising out of the exchange of the bicycles or from the repair and . e of said bicycles. d. To comply wil all applicable laws, ordinances and codes of the state and local governm nts. 3. Nothing in this agr: ent is intended to or shall be construed in a manner as creating or establishi : the relationship of employer /employee between parties. Youth Express is and shall be at all times independent of the City of Saint Paul or its police departm. t. 4. This is a one time ag - ment for the time period of the date of this agreement to August 1, 1995.
