RESOLVED, that upon the petition of the City of Saint Paul, per Finance Department File No.
9 -1994, that part of Lot 14, Partition Plat to Saint Paul, that lies east of Western Avenue,
southerly of St. Clair Avenue and north of the easterly extension of Jefferson Avenue,
hereinafter described, is hereby vacated and discontinued as public property.
The vacated area is described as follows:
That part of Lot 14, Partition Plat and Addition to Saint Paul, Minnesota, being
a subdivision of the Northwest Quarter of the Northeast Quarter and Government
Lot 2, Section 12, Township 28, Range 23, Ramsey County, Minnesota described
as follows:
Commencing at tie intersection of the west line of Lot 8, said Partition
Plat and Additio with the northerly levee line as established by order of
Common Council dated April 22, 1886, filed June 27, 1888, in the office of
the Registrar of 1 eeds, Ramsey County, Minnesota, and recorded in Book
4 of street openi :s, page 22; thence north along the west line of said Lot
8 a distance of 3 . .66 feet to its intersection with the easterly extension of
the south line of :lock 16, Stinson, Brown and Ramsey's Addition to Saint
Paul, Ramsey Co nty, Minnesota; thence westerly along said south line
and its extension 31.72 feet; thence northeasterly, angle left 49 degrees 23
minutes 1683.0 fe t to the point of beginning of the parcel to be described;
thence continuing northeasterly to the west line of the east 65 feet of said
Lot 14; thence s . uth along said west line 10.0 feet; thence southwesterly
to the point of beginning.
This vacation shall be subject tct the following conditions:
1. That this vacation shall le subject to the terms and condition of Chapter 130,
codified March 1, 1981, , f the Saint Paul Legislative Code as amended
2. That the Council of the ity of Saint Paul hereby authorizes the proper City

Officials to convey the v : cated land described above to the Soo Line Railroad by
Quit Claim Deed.
3. That the petitioner, its s ccessors, and assigns, by acceptance of the terms and
conditions of this resolu on agree to indemnify, defend and save harmless the
City of Saint Paul, its of cers, and employees from all suits, actions, or claims
of any character brought as a result of injuries or damages received or
sustained by any person, persons, or property on account of this vacation or
petitioner's use of this p operty, including but not limited to a claim brought

v (, because of any claims or liability arising from any violation of any law or
regulation made in accordance with the law, whether by the petitioner or any
of its agents or employees.
4. That the petitioner, its successors, and assigns, shall within 60 days of the
publication date of this resolution, file with the City Clerk and acceptance in
writing of the conditions of this resolution and shall within the period(s)
specified in the terms and conditions of this resolution, comply in all respects
with these terms and cor ditions.
