Christine Rozek, being first duly sworn upon oath deposes and says:
1. That she is employed by the City of Saint Paul as a manager in the Office of License,
Inspections and Environmental Protection (LIEP).
2. That on August 31, 1995 your affiant entered into an agreement with Mr. Arnold J.
Kempa, as representative of P.L.A.B., d/b /a Ted's Recreation (hereafter "Licensee "). (See
Attachment A.) As of that date the Licensee had not yet made payment on 1995 license fees
which were due and owing on January 31, 1995. The total amount due and owing was
$3,417.00.
3. That non - payment of license fees is grounds for adverse action against the licenses held
by the Licensee under the Saint Paul Legislative Code § 310.06 and § 310.09 and paragraph 3.
of the August 31, 1995 agreement.
4. That the agreement, signed by your affiant and the Licensee, called for LIEP to halt the
adverse action against the licenses held by the Licensee. In return, the Licensee agreed to make
monthly payments of $800.00 on or before the 20th of each month, towards the amount due and
owing, with a $1,017.00 payment on or before December 20, 1995.

5. That the Licensee has not made payment toward neither the October payment, nor the
November payment. Specifically, on October 24, 1995, LIEP received a check in the amount
of $800.00 from the Licensee. When presented for payment, however, the check ( #9028; see
attachment B) was returned for insufficient funds. This check was in fact presented again, with
the same result. No payment, in the form of a check or otherwise, has been presented for the
amount due November 20, 1995.
6. That as of December 1, 1995, the Licensee has made no further attempts to make
payments towards the amounts due and owing, nor contact LIEP regarding this niatter.
7. That pursuant to the August 31, 1995 agreement, failure to make payments as set forth
in the agreement shall be deemed a violation of the licenses held by the Licensee, authorizing
adverse action against the licenses of P.L.A.B., Inc. Additionally, pursuant to the August 31,
1995 agreement, Licensee agreed to waive the right to a hearing before an independent hearing
examiner on the issue of nonpayment of license fees and proceed directly to a hearing before the
Saint Paul City Council for determination of the penalty.
8. That your affiant and LIEP have at all times relative to this matter acted in good faith
while seeking payment from the Licensee.
9. That this affidavit is made in support of LIEP's adverse action against the licenses held
by the Licensee.

1. That full payment of the 1995 license fees and penalties, totaling $3,417.00, shall be
made on or before December 20, 1995; payments are to be made as follows:

Dear Mr. and Mrs. Kampa:
I am in receipt of information that could lead to adverse action .
against all your licenses. The basis for adverse action is:
On or about January 31, 1995, you submitted your required
license fees with a check that was returned ""NSF" to the
license office. You have failed to pay your license fees
since then, despite several requests by LIEP staff to do
that. This constitutes grounds for the revocation of your
licenses. -
If you do not dispute the above facts, this matter will be
scheduled before the City Council for a hearing on what penalty, if
any, to impose. You will be allowed to speak on you behalf at that
hearing. I will need to have a letter from you saying that you do
not dispute the facts if we are going to follow that path.
On the other hand, if you dispute the above facts, I will schedule
the evidentiary hearing on the facts before an Administrative Law
Judge. In that event, you will receive a notice of hearing so you
will know when and where to appear, and what the basis for the
hearing will be.
In either case, you should contact me within five days from the
date of this letter. If I do not hear from you, I will schedule
the hearing, and you may be responsible for the costs of the
hearing if you do not then appear and contest the facts. Please
call me or have your attorney call me at 266 -8710.
