(Lic. ID No. 69458) located at 33 7th Place West in Saint Paul . This 4 action is taken as an uncontested adverse action as stipulated to by the Licensee in the 5 attached "Stipulation of Facts and Recommendation." 6 7 1. The licensee shall make full payment of all licenses fees on or before the dates such 8 fees become due and owing, and shall do so without a request by LIEP. 9 10 2. If the licensee fails to comply with Condition No. 1, LIEP shall be entitled to schedule 11 a hearing before the City Council for the purpose of adverse action against all licenses 12 held by the licensee, at which hearing the fact of the violation of Condition No. 1 shall 13 not be contested by the licensee. The licensee does not waive the right to argue to the City Council that, despite the 22 violation of Condition NO.1, the council not follow LIEP's recommendation, or that 23 the City Council impose a different penalty or take no adverse action. Castillo) d/b /a Francesca's Bakery & Cafe at the premises located at 33 W. 7th Place, Saint Paul (hereafter "licensee "), having been scheduled for a hearing before an Administrative Law Judge on October 5, 1995 has been amicably settled by the parties. It is hereby stipulated, by and between the undersigned parties that: 1. The licensee is a holder of a restaurant, bakery and catering license in the City of Saint Paul. At times during the past two years the licensee has also held On -sale Wine and On- sale Malt licenses. 2. Over the past two years the licensee has repeatedly failed to pay, on a timely basis, license fees due and owing the City. Staff has consistently attempted to work with the licensee to obtain compliance and has made repeated contacts and requests for payment. This effort has taken an inordinate amount of staff time and effort, and takes them away from other duties which are pressing and important. The licensee's consistent failure to pay is the conduct upon which this adverse action is based and which warrants the following conditions be placed on all licenses held by the licensee. RECOMMENDATION It is hereby recommended by the Office of LIEP and agreed upon by the licensee that the following conditions be placed upon the licenses currently held by the licensee: 1. The licensee shall make full payment of all license fees on or before the dates such fees become due and owing, and shall do so without a request by LIEP. 2. Breach of this condition would subject you to adverse action against your licenses, which could include revocation, suspension, the payment of late fees and fines in addition to overdue license fees, and the imposition of additional conditions. Based on the information now known to the license office, it would be willing to propose and recommend to the City Council that the Council impose the foregoing condition on the license, and further recommend that there be no further discipline or sanction at this time against the license. This would mean that, if the Council adopts that recommendation, there would not be a full -scale contested case hearing. In order to do that, you would have to enter into a stipulation as to the facts and waive the necessity for a contested case hearing. The facts to be stipulated to would be based on those stated in the first paragraph of this letter. The Council is the ultimate judge in all such matters, and the matter would be decided by them, whether this goes to a contested case hearing, or is dealt with on a stipulation as to the facts.
