This property 5 is legally described as follows, to wit: 6 7 Lot 3, Block 9, Tracys Outlots in the Township of New C. ada, Ramsey County and 8 State of Minnesota. 9 10 WHEREAS, based upon the records in the Ramsey County Recorder's Office and 11 information obtained by Saint Paul Public Health on or before October 24, 1995, the following are 12 the now known interested or responsible parties for the S . eject Property: Ken Blodgett, 895 Johnson 13 Parkway, St. Paul, MN 55106; Pacesetter Corp., dba Pacesetter Products of Minnesota, Inc., 1110 14 New Brighton Rd., Minneapolis, MN 55413; Norwe Mortgage, 2051 Killebrew Drive, 15 Bloomington, MN 55479 -2549, Attn: Sally Berdt. 16 17 WHEREAS, Saint Paul Public Health has served in accordance with the provisions of 18 Chapter 45 of the Saint Paul Legislative Code . order identified as an "Order to Abate Nuisance 19 Building(s)" dated October 19, 1995; and 20 21 WHEREAS, this order informed t ' then known interested or responsible parties that the 22 structure located on the Subject Property s a nuisance building(s) pursuant to Chapter 45; and 23 24 WHEREAS, this order inform= • the interested or responsible parties that they must repair or 25 demolish the structure located on the Subject Property by November 20, 1995; and 26 27 WHEREAS, the enforcem; t officer has posted a placard on the Subject Property declaring 28 this building(s) to constitute a n sane condition; subject to demolition; and 29 30 WHEREAS, this nuisa ' ce condition has not been corrected and Saint Paul Public Health 31 requested that the City Clerk schedule public hearings before the Legislative Hearing Officer of the 32 City Council and the Saint ' aul City Council; and 33 34 WHEREAS, the i terested and responsible parties have been served notice in accordance 35 with the provisions of apter 45 of the Saint Paul Legislative Code, of the time, date, place and 36 purpose of the public ' earings; and 37 38 WHEREAS a hearing was held before the Legislative Hearing Officer of the Saint Paul City 39 Council on Tuesd , December 19, 1995 to hear testimony and evidence, and after receiving 40 testimony and e idence, made the recommendation to approve the request to order the interested or 41 responsible pa ies to make the Subject Property safe and not detrimental to the public peace, health, 42 safety and welfare and remove its blighting influence on the community by rehabilitating this 43 structure in accordance with all applicable codes and ordinances, or in the alternative by 44 demolishing and removing the structure in accordance with all applicable codes and ordinances. tJ CIG1NAL �� „ c , 73--/s7 1 The rehabilitation or demolition of the structure to be completed within fifteen (15) da s after the 2 date of the Council Hearing; and 3 4 WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, 5 December 27, 1995 and the testimony and evidence including the action taken % the Legislative 6 Hearing Officer was considered by the Council; now therefore 7 8 BE IT RESOLVED, that based upon the testimony and evidence ! esented at the above 9 referenced public hearings, the Saint Paul City Council hereby adopts t• - following Findings and 10 Order concerning the Subject Property at 899 Johnson Parkway: 11 12 1. That the Subject Property comprises a nuisance con. tion as defined in Saint Paul 13 Legislative Code, Chapter 45. 14 15 2. That the costs of demolition and removal of t • building(s) is estimated to exceed 16 three thousand dollars ($3,000.00). 17 18 3. That there now exists and has existed mu iple Housing or Building code violations at 19 the Subject Property. 20 21 4. That an Order to Abate Nuisance B lding(s) was sent to the then known responsible 22 parties to correct the deficiencies • to demolish and remove the building(s). 23 24 5. That the deficiencies causing t 's nuisance condition have not been corrected. 25 26 6. That Public Health has post: i a placard on the Subject Property which declares it to 27 be a nuisance condition su ► ect to demolition. 28 29 7. That this building has b; en routinely monitored by the Vacant /Nuisance Buildings 30 Code Enforcement Pr• :ram. 31 32 8. That the known int-. ested parties and owners are as previously stated in this 33 resolution and that the notification requirements of Chapter 45 have been fulfilled. 34 35 ORDER 36 37 The Saint Paul City ' ouncil hereby makes the following order: 38 39 1. The above refere ed interested or responsible parties shall make the Subject Property safe 40 and not detrime al to the public peace, health, safety and welfare and remove its blighting 41 influence on t • community by rehabilitating this structure and correcting all deficiencies as 42 prescribed in he above referenced Order to Abate Nuisance Building(s) in accordance with 43 all applicab - codes and ordinances, or in the alternative by demolishing and removing the 44 structure • accordance with all applicable codes and ordinances. The rehabilitation or 45 demoliti• and removal of the structure must be completed within fifteen (15) days after the 46 date of the Council Hearing. 1 2. If the above corrective action is not completed within this period of time th City of Saint 2 Paul, Public Health, Housing Code Enforcement Section is hereby autho zed to take 3 whatever steps are necessary to demolish and remove this structure, fil he site and charge 4 the costs incurred against the Subject Property pursuant to the provis'.ns of Chapter 45 of 5 the Saint Paul Legislative Code. 6 7 3. In the event the building is to be demolished and removed by t - City of Saint Paul, all 8 personal property or fixtures of any kind which interfere wit the demolition and removal 9 shall be removed from the property by the responsible parti; s by the end of this time period. 10 If all personal property is not removed, it shall be consid ed to be abandoned and the City 11 of Saint Paul shall remove and dispose of such property .s provided by law. 12 13 4. It is further ordered, that a copy of this resolution b= mailed to the owners and interested 14 parties in accordance with Chapter 45 of the Saint 'aul Legislative Code. Inasmuch as this Order to Abate has not been complied with the nuisance condition remains unabated, the community continues to suffer the blighting influence of this property. It is the recommendation of Public Health that the City Council pass a resolution ordering the responsible parties to either repair, or demolish and remove this building in a timely manner, and failing that, authorize Public Health to proceed to demolition and removal, and to assess the costs incurred against the real estate as a special assessment to be collected in the same manner as taxes.
