95-812�������� Presented Referred `a�,,. � � ( � � 95 Counci File # � S � c� ' � �reen sheet # 3 3 y 3 3 RESOLUTION OF SAINT PAUL, MINI�ESOTA Whereas, The ordinance establishing the user charge for excessive consumption of police services contemplates the Council enacting a resolution recommending guidelines for the enforcement of the ordinance by the Police Department; and Whereas, Public hearings conducted by the Council when considering the adoption of this ordinance raised concerns that certain calls for police services may be initiated by the conduct of third persons not either residents or guests of the residence; and Whereas, The Council believes that the intent of the ordinance is not to penalize victims of those types of activities and therefore should Ae exoluded from possible charges for services; now therePore be it Resolved, That the Police Chief shall include the followinq in departmental guidelines;- and that this guideline will be �resented t� for its review and ado tion before implementation: Calls for assistance involving domestic abuse defined in Minnesota Statutes section 518B.01 and harassment and stalking defined in Minnesota Statutes section 609.749 will not be considered to constitute a nuisance event. Calls for service will be considered a nuisance event only when specific units in a multiple-unit structure are identified as responsible for the nuisance event. No individual police officer will be able to make the decision to impose a police services fee independently. Police officers, their supervisor and Police Commander will make the decision. The Chief of Police, or the Chief's designee, will make the final decision. The threshold for imposing the "police services fee" by the Police Department will be for the fifth ca11 for service in a 30-day period to a spacific property. The City Council will review this policy and will make changes as deemed necessary to aid in the implementation of the ordinance. Before any oharges for "police services fee" the property owner will be notified when a pattern is identified and will be qiven the opportunity to work with the police and the community to alleviate the problem. 1 � z 3 4 5 6 7 8 � s - � � �-- Appeals to any charges Por "police service fees" can be reviewed by the City Council.
