95-658Council File # ��� � ��lr1f'�A Green Sheet #35036 RESOLUTION �INT PAUL, MINNESOTA Presented Re£erred To 1 2 3 �� Committee: Date An Admurisuative Resolution amending the Civil Service Rules regarding employee's appointment date. 4 RFSOLVED, that the Civil Service Rules be amended in Section 22, Layoff, so that said Section 22 5 shail read as follows: 6 22 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 LAYOFF For the pur�ose of determinin sg enio� in la�offs described in this Rule the following procedure shali be used The seniority of a person serving in a class which is effected by a lavoff and who was appointed to that class prior to Julv 1. 1995. shall be determined by the date that such emplovee was certified and a�pointed to that class The seniority of a person servi� in a class which is effected by a layoff. and who was appointerl on or after July 1. 1995 shall be determined by the date that such emplovee first reported for duty for emplovment in such class. Whenever it becomes necessary in any division for lack of work or funds, or for other causes, to reduce the force in any class of positions, the appointing officer shall designate the class from which layoff shall take place. Persons serving in that class shall be laid off in the inverse order of their ; �"°" '-� `"� r , �:a �" seniority in the manner described above. However, all temporary and provisional appointees in that class shall in all cases be separated first. For the purpose of this subsection, persons appointed to the same class on the same date shail be considered to have seniority in the order on which they appeared on the certification. When an employee has been laid off, itisfkef the empiovee's name shall be placed on the appropriate reinstatement register, and �efske the emplovee shall be reinstated in accordance with the reinstatement provisions of these Rules except that #�eFs�ie the emplovee may be reinstated at any time within two years after such layoff. The appointing officer shall give two weeks notice to any employee being laid off, except in cases of seasonal, temporary, intermittent, or similar employment or in cases of unforeseeable lack of work. , �is-� sg� d� 29 If a�e class has been abolished and the position it described exists under a new fi�le class� 30 then the seniority of employees who have held a nosition in the former t�e class shall be 31 determined as if the former �fi3e class still existed. 32 If two or more � classes have been included in one new �le, class, seniority will be 33 deternuned for all affected employees as if the � classes had always been one fi�e class. 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 52 If a#�le class or series of fi�3es classes is abolished due to a cessarion of a type of work and all incumbents are transfened to a new fi�ke class or series of t�kes classes, their seniority with respect to each other will be determined by the process described above. If they are transfened into a fi�tie class in which others hold uositions or have heid nositions, their seniority with respect to those incumbents will be determined by the date of their transfer. As to all other persons, their seniority will be determined by the process described above. If a series of ti�les classes has been abolished which aze pazatlel and equal to another existing series, the employees holding vositions within such �les classes shall have bumping rights as if their old �ii�es classes had always been in the parallel series. If a�le class has been regraded and an employee who formerly held a position within this #itie class in a different grade rerluces to it to avoid layoff, said employee will be reinstated to the fi�e class at the higher of the two grades. Empioyees appointed under a multiple appointment shall be considered on layoff from those t�les classes covered by the multiple appointment for the periods of rime not worked in such fi�les classes. Currently, two dates are used for determining semonty. For purposes of layoff, class seniority is used. Ciass seniority is the date an employee was certitied and appointed to the class (tide) affecYed by the layoff. For the purpose of determin� pay increases, vacation accrual, sick leave accruai, years of service recognition, and pension, the date an employee began working in a dass is used. Having two seniority dates has caused confusion among employees, administrative problems, and situations where an employee with more service credit in a class being laid off before an employee with less service credit. 1. There would be only one occupadon date entered in the records system. This will eliminate tcvo required data fields and reduce the time spent determining wlvch dates to use when progamming reports and figuring out seniority. Also, there would be reduced chances for errors. 2. 1'Le coafusion over seniority dates would be eGminated for employees hired on or after July 1, 1995. 3. Inequitable situafions would be eliminated such as an employee who was appointed before another employee hac�ing greater class senioriry even though the other employee actually began working in the cSass at an eazlier date.
