Paul, the proper City officers are hereby authorized and directed to pay out of the Tort
Liabiliiy Fund 09070-0511 to Creighton Pendarvis the sum of $3,700.00 in full settlement of
his claim for damages sustained July 21, 1992, as a result of an accident on the dock at the
Watergate Marina.

While at the Watergate Marina on July 21, 1992, Creighton Pendarvis
alleges he fell through a covered hole on the dock. The Division
of Parks and Recreation was in the process of repairing the docks
at the Marina, but workers deny the area was left in a hazardous
condition.
Mr. Pendarvis brought suit against the City in Ramsey County
ADVANTAGESI �e�a�� ° 'ring the docks. Pendarvis injured his left leg during the
fall, and allegedly incurred medical expenses and wage loss.
The City has denied plaintiffrs claims and asserted various
defenses. Our office has entered into a settlement agreement with
Mr. Pendarvis for the sum of $3,700.00, in exchange for the release
of a11 Plaintiff's claims. our office recommends approval.
