PRELINIINARY AND FINAL PLAT FOR
ATLAS ADDITION
WHEREAS, Dart Transfer Company has submitted the attached preluninary and final plat for City
Council approval; and
WHEREAS, the appropriate city departments have reviewed the plat and found it to meet the requirements
of Chapter 67 of the Zoning Code; and
WHEREAS, notice of the public hearing before the City Council was duly published in the official
newspaper of the city and notices were mailed to each owner of affected property and property situated
wholly of partly within 350 feet of the subject property; and
WHEREAS, a public hearing before the City Council was held on May 17, 1995, at which all interested
parties were heazd, the Councii having considered all the facts and recommendations concerning the plat;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached
preliminaty and final plat of Atlas Addition by Dart Transfer Company.

A. PURPOSE: To consider a greliminary and final for At1as Addition to allow
subdivision of the existing property into two newly described lots. The
property has not been previously platted and Chapter 67 of the Zoning Code
requires the property to be platCed prior to any subdivision.
B. SITE & AREA CONDITIONS: The site is occupied by an office building along
University Avenue and a concrete building on the south portion of the
properCy along Cleveland Avenue. The proposed south lot is nearly
entirely paved with asphalt and used as a trailer storage area. The area
around the site contains a variety o£ retail, of£ice and industrial uses.
C. BACKGROUND: The applicant requests the preliminary and final plat to allow
• subdivision o£ the existing property. The applicant requests the
subdivision to allow American Engineering Testing (A.E.T.1 to purchase the
property. A.E.T. has a purchase agreement to buy the south lot and an
option to buy the north lot at a later date. The subdivision is necessary
to allow A.E.T. to purchase the south lot and north lots at different
times. A.E.T. plans to lease the building on the north lot until they
choose to exercise their option to purchase the north property. This
preliminary and final plat is not a requirement for any future improvements
of the site.
D. DISTRICT COUNCIL RECOMMENDATION: The Merriam Park Community Council
unanimously voted to recommend approval of Atlas Addition at its April 12,
1995 meeting.
E. REOUIRED FINDINGS:
1. All the app2icable provisions of the Legislative Code are complied
wi th .
City staff have reviewed the proposed preliminary and final plat and
determined that it meets all reguirements and standards of the City.
2. The proposed subdivision will not be detrimenCal to the present and
potential surrounding land uses.
The property is developed with uses compatible to the area.
3. The area surrounding the suBdivision can be planned and developed in
coordination and compatibiZity with the proposed subdivision.
• The surrounding area and the area of the proposed preliminary and final
plat are compatible with respect to land uses.

4. The subdivision is in conformance with the Comprehensive Plan.
The property is in compliance with the comprehensive plan Eor this area of
the city.
5. The subdivision preserves and incosporates the site's important
exisCing natural features, whenever possible.
The division between lots 1& 2 follows an existing change in grade.
6. AlI land intended for building sites can be used safely without
endangering the residents by peril from floods, erosion,
continuously high water table, severe soil conditions or other
menace.
The land is and can be safely developed.
7. The subdivision can be economically served with public facilities
and services.
The property can and is served by public facilities and services.
F. STAFF RECOMMENDATION: Based on the above findings, staff recommends
approval of the preliminary and final plat for Atlas Addition by Dart
• Transfer Company.
