95-415�RIG[N�� Council File # /�7�� Green Sheet # a9Gcs � Presented By Referred to Committee: Date 13 1 WHEREAS, Cafesjians Carousel, owned by the City and operated by Our Fair Carousel 2 Incorporated was scheduled to cease operations as of February 5, 1995 due to lack of 3 ridership and revenue losses; and 4 5 WHEREAS, Our Fair Carousel has agreed to continue operating the carousel through 6 April 15, 1995, and to keep the Carousel in its present location until a marketing plan 7 for the carousel can be completed; and 8 9 WHEREAS, Our Fair Carousel Incorporated's liability insurance coverage will run out l� as of April 30, 1995; and 11 12 WHEREAS, The carousel will not be operated on a regular basis between April 15, 1995 13 and approximately September 15, 1995, a date corresponding with the opening of the 14 Childrens Museum; and 15 16 WHEREAS, The carousel will need liability coverage during the period it will not be 17 in regular operaCion; 18 19 NOW TAEREFORE BE IT RESOLVED, that the City of Saint Paul shall accept liability 20 responsibility for any liability claims made against the carousel, Our Fair Carousel 21 Incorporated, the City of Saint Paul, The Sharlard Group Inc. and Travelers Insurance 22 Company but subject to the limits of Minnesota Statute 466 and further this 23 indemnification shall expire October l, 1995. It is hoped that the opening of the Chi]drens Museum wil] he]p increase ridership. During this period OEC cannot afford to pay liability insurance since they will not be receiving any revenue. The Carousel will have liability coverage and can remain in place in Town Square Park.
