Condemnation and taking of permanent easements £or public right-of- I
way purposes near Prosperity Avenue and Rose Avenue described as �i
follows: I
The west 5.00 £eet of the east 9.22 feet of the Northwe5t
QuaYter of said Northwest Quarter, which lies northerly
of said Easc Rose Avenue;
Also, that part of the north one-half of said Northwest
QuaYter which lies southerly of trie southerly right-of-
way line of said East Rose Avenue and northerly of a line
described as beginning at the point of intersection of
said southerly right-of-way line with a line parallel
with and 470.50 feet westerly from the west line of
Maryland Heights according to the recorded plat thereof;
thence easterly parallel with the north line of said
Northwest Quarter to a point that is distant 187.54 feet
feet westerly from the west line of said Maryland
Heights; thence easterly 197.2 feet more or less to the
northwest corner of Block 3, sid Maryland Heights and
there said line terminates;
Also, the north 10.00 feet of the following:
Subject to street, the west 130.25 feet of the east
139.47 feet of the Northwest 4uarter of the Northwest
Quarter of Section 27, Township 29 North, Range 22 West;

Subdivision o£ Lots 9 and 10, Block 4 of Rogers and
Hendricks Acre Lots Number 2 lying northwesterly of a
line described as beginning at the northerly nost corner
of 5aid Lot 12; thence southwesterly to a point on the
South line of said Lot 14 distant 30.00 feet east oY the
southwest corner of said Lot 14 and there terminating.
The Director of Finance having submitted his report m the above matter as to the amount of damages awarded
for the taking of the land or easements therein appropriated for the above improvement and to whom payable; and
also having submitted his assessment of benefits to property from the making of said improvement, therefore be it
RESOLVED, That the said assessment of benefits be and the same is hereby approved.
RESOLVED FURTHER, That a public heaiing be had before the Council upon said report and for a confirmafion
of the awacd of damages made by tha Directoi of Finance and also upon the said assessment of benefits; at the Council
Chamber, in the Court House in the City of St. Paul on the 10th day of
Mav. 1995, at 3:30 P.M. , and that the Director of Finance be and
he is directed to give nofice of said hearing as prescribed by the Charter.

project is planned to realign Prosperity Avenue at Maryland and Rose Avenues during the 1995
onstruction season. The acquisition of these easements is necessary to construct the roadway as planned.
DVANI'AGPS IF APYROVID:
Roadway could be constructed as planned, and cars would no longer have to turn onto and off of
Alaryland Avenue to travel on Prosperity Avenue, resulting in a smoother and safer traffic flow for both
Prosperity and Maryland.
DISADVANIAGES TF APPROVID:
he roadway easements would become an encumbrance on the affected properties. Also, the o.��ers of the
aff'ected properties would have fo be compensated for the taking of these roadway easements.
