WI3EREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Saint Paul Public Health on or before December 2, 1994, the
following are the now l�own interested or responsible parties for the Subject Property:
Veterans Affairs I,oan Guazanty Division, Whipple Federal Bldg, #8, Fort Snelling, MN.,
55111-400'7; Donna Kapaun, 2499 Rice Street, #120, St. Paul, MN., SSll3; and Sununit-
University Planning Council, 627 Selby Avenue, St. Paul, MN., 55104 (Attn: Greg); and
WF�REAS, in accordance with provisions and procedures outlined by the Saint Paul
L.egislative Code, notices of said hearings were given to said responsible parties, and public
hearings (on February 21, March 8, and March 22, 1995) were held to discuss the Subject
Property, and a Resolution (95-2ll) passed by the City Council recommending the removal
of said structure; and
WFIEREAS, the Mayor approved said Resolution 95-211 on March 29, 1995; and
WHEREAS, from and after the date of said Mayoral approval it has come to the
attention of the City that an immediate demolition and removal of the building located at
898 Selby Avenue may not be in the best interests of the citizens of Saint Paul because said
properiy may be rehabitable and put to a better use in the event the location is re-zoned
partially commercial and that the Subject Property may, in fact, later be rehabilitated and
subsequently legally incorporated into such use; and
WHEREAS, Saint Paul Public Health had previously requested the City Council to hold
public hearings to consider the advisability and necessity of ordering the repair or wrecldng
and removal of a two-story, wood-frame dwelling located on property hereinafter referred
to as the "Subject Property," and commonly known as 898 Selby Avenue; and this properry
is legally described as follows, to-wit:

WHEREAS, it appeazs to be in the best interests of Saint Paul and the coznmunity
surrounding the Subject Properry to consider the feasibility of a possible re-zoning plan and
concurrent rehabilitation of the Subject Property,
NOW, THEREFORE, BE IT RESOLVED, that based upon the foregoing
considerations, that portion only of Resolution 95-211 cailing £or the demolition of this
properry should be rescinded, and that, in all other respects, Resolution 95-211 finding the
Subject Properry a nuisance shall remain in effect, and that the present rescission shall allow
only for a period of 180 days from the date of this Council Hearing within which to explore
the feasibility of rehabilitating the property, especially in light of any possible plan to re-
zone the area as partially commercial, and that after said period, if the property continues
as a nuisance, that demolition remains a viable legal remedy through action by this Council.

The Saint Paul City Council hereby makes the following order:
1. City Council Resolution 95-2ll shall remain in fiill force and effect, save that portion
calling for the demolition of the Subject Property is rescinded; and there shall be a period
of 180 days within which to e�lore the feasibility of rehabilitation of the Subject Property
and possibly incorporating said structure into any producdve use, including commercial use,
such that immediate demolition to abate the existing nuisance is presently inadvisable; and
that City Council Resoluuon 95-211, in that respect, is hereby rescinded, but allowing for
abatement of this nuisance through demolition, if necessary, after the e�iration of said 180
days from the date of this Council Hearing, in the event there has been no substantia]
change in the Subject Property to conform to legal use.
