is hereby ordered to pay a fine of $200 for the violation of the sale of tobacco or tobacco
products to a minor.
Said fine shall be paid to the Office of License, Inspections and Environmental
Protection within thirty (30) days of the adoption of ttris resolution by the Council and
signature by the Mayor.
This resolution and the action of the Council in this matter are based upon the
facts contained in the letter nouce of the violation to the licensee, the LIEP inspection

Please take notice that a hearing concerning the above-named
establishment has been scheduled for 3:30 p.m., January il, 1994,
in the City Council Chambers, Third Floor, Saint Paul City Hall and
Ramsey County Courthouse.
Enclosed are copies of the proposed resolution and other documents
which will be presented to the City Council for their

Re: Cigarette sale to minor compliance check summay
On October 19 and 26, 1994 betu>een tbe bours of 2:30 p.m. and
5:05 p.m, and on October 22, 1994 betu�een the hours of 10:00 a.m.
and 1:30 p.m., I accompanied Elo Alston, age sixteen, to fifty-five
licensed cigarette retail establishments for tbe purpose of
detern ��ng if such licensees would sell cigarettes to a minor in
violation of Section 3?4.07 of tbe Saint Paui L,egislative Code and in
violation of Minn. Stat. § 609.68�. :�Ir. Alston's physical description
is as follows: African American, 5'll", shaved black hair (curly),
weight 180 pounds, thin moustache. On the date(s) and time
period(s) of the compliance cbecks, Mr. Alston wore a black leather
jacket and blue jeans. Mr. Alston wore a high school class ring on
his right ring finger (Class of 1995).
It was determined that, during the dates specified, fifty-five licensed
cigarette retail establishmenu would be investigated.
A list of routes has been pre-established in order to determine
which establishments will be cbecked and in which order. The order
of the routs has been set up as close to randomly as possible and
every licensed cigarette retail establishment has been included in the
route system. This is so that the City of Saint Paul can comply with
the obligations associated with their acceptance of the ASSIST
Grant for $5,000 and the $2,000 grant from tbe State of Minnesota
Department of Human Services.
The investigation procedure consisted of sending the minor into
respective listed establishments attempting to purchase a pack of
cigazettes. At no time did the minor produce false identificauon
showing an inconect age. At no time did said minor possess a false
identification card or license. After the minor retumed to tbe car
and informed me of such sale and of which employee soid such
tobacco products (identification was made by name tag, pbysical
description, and by particular counter), I entered the establishment

sale of cigarettes to a minor v.�as made and that this act conctiruted
a gross misdemeanor pu:.i�hable of up to 5�00.00, znd could result
in adierse action aRainst tne license o: licenses held. I then asked
for their name and rzcorded it on a copy of the compliance check
slips used as a record of e�tablishmenu checked and as e��idence
against those who are found not to comply. I recorded any other
relevant commenu or information. If the employee or manager of
the establishment voiced aay kind of o5jection, I recponded in clear
terms that due process uould be afforded to them. Receipts were
retained when possible and tbe cigarette tas number �°as recorded
on the information slip corresponding � the establishment in
question. The receipts and cigarettes zre given to you in
conjunction with this report.
Of tbe fifty-five establish�ents investigated, three cigarette retailers
did sell cigarettes to said minor. The following is a list of such
licensees, tbe time of sale and the name of the employee wbo
conducted the sale in the order they were checked:

The Office of License, Inspections �.d Em�irorunenta] Protection W�ill recommend to the
Saint Paul City Councff th2t advene action be taken against all the licenses you hold 2t
the above-nazned premises. This recommendation is based on the folloav:g:
On October 19, 1994, a clerk or other employee sold cigarettes to a minor
under the age of 18 years in the licensed premises. This is an offense
under Minn. Stat. §609.685 znd Section 324.07 of the Saint Paul
I,egislative Code. This offense is the basis for an action against all your
licenses under Section 310.G6(b) of the 7xgislative Code.
The recommendation of this ofHce is a$200 fine for the first offense as called for in the
Saint Paul Legislative Code as cited above. If you do not dispute the above facts, send
me a fax or letter to that effect within 5 days. The case will be set before the City
Council in the ne2r future and you a�ill receive further notice to this regard.
If you da dispute the f2cts stated zbove, you may request a hearing before an
Administrative Taw Judge (AI�. The AI.J will hold a trial-type hearing at u>hich both
you and the City W�ill be able to appear and present witnesses, evidence and cross-
e�camine the other's w�itnesses. The Council will decide the matter at a Jater public
hearing after it recei� es che report of the ALJ. Please ]et me know w�ithin 5 days if you
u�ish this altemate procedure and v.•e will take the necessary steps to schedule it for

Dear Mr. Kessler:
This letter is in response to the Notice of Complaint dated November 2, 1994, directed
to Holiday Stationstores, Inc. ("Holiday"). Holiday will not challenge the Notice of
Compiaint, and for purpose of this letter, will adopt the facts as set forth in the
Complaint. This is not, however, to be interpreted as an admission of any fact or of
fiability. '
Comp4ying with the 4aw prohibiting the sale of tobacco and alcohol to minors is a priority
for Holiday. As a result Holiday has established numerous procedures and policies to
ensure that minors are not permitted to purchase cigarettes. For example, Holiday has
developed a video-based traming program for sales personnel in the Stationstores. This
video instructs when and how to ask for identification, as well as acceptable forms of
identification. The video informs employees that they must request proper identification
from any individuai who appears to be 25 years old or younger. Once the tobacco sales
part of the video program is compfeted, the employee signs a document indicating that
slhe understands state law regarding tobacco sales. Exhibit A. Moreover, our training
program also includes a review questionnaire on tobacco/a{cohol sales to reemphasize
the importance of requesting identification. Exhibit B. Holiday also shows new
employees a series of pictures of people of various ages so the employees can practice
judging which individuals appear to be 25 or younger. Exhibit C.
Further, the Stationstore Manager and the District Manager review tobacco sales
procedure with the empioyees. The metro-area District Managers visit each Stationstore
in their district two or three times each week. On these visits the District Manager
reminds the employees about various store policies including the prohibition of the sale
of tobacco and alcohol to minors. Again, employees are instructed .to "card" any

individual that appears to be 25 years of age or younger
required to wear a button which states "1 Check
Purchases". This button is attached as Exhibit D.

Signs are displayed in the Stationstores to remind both customers and cashiers that the
sa(e of tobacco products to minors under the age of 18 is prohibited. These signs are
brightly colored and prominentiy displayed. I attach a copy of these signs as Exhibit E.
After the alleged incident in October occurred, the Sales Associate that made the sale
voluntarily quit. The Stationstore Manager was reprimanded by being issued a written
warning. All District Managers of Holiday have warned the Stationstore Managers and
the Sales Associates that Holiday must continue to strictly adhere to state law regarding
the sale of a{coho{ and tobacco.
Hofiday Stationstores, Inc. will continue to +nstruct its employees about the prohibition
of the sale of tobacco to minors. All efforts will be made to ensure that cashiers "card"
all individuais who appear to be 25 years old or younger before tobacco is sold to them.

guesszd ircorrectly about the age of any one of the
six pictures on ihe cover, it shows how easily you
could make the mistake of seliing those products to
underage customers.
The legal age to buy tobacco products is 18.
Tobacco products include:
- Cigarettes - Cigarette Roiling Papers
- Cigars - Pipe Tobacco
- Chewing Tobacco
The legal age to buy alcohol is 21.
Before you begin a tobacco or aicohol transaction,
ask any customer who appears 25 years old or
younger for valid identification. The only forms of
identification accepted by Holiday are a valid state
driver's license with photo, or a valid state-issued
identification card with photo. When you think a per-
son is not old enough to buy tobacco or alcohoi prod-
ucts and he or she can't produce acceptable ID, don't
make the sale!
" REMEMBER
Don't try to determine if a customer is 18 or 21! It's
too difficult. Just observe whether the customer
appears to be 25 years old or younger. if so, ask for

Dear Mr. Rush:
Please take notice that a hearing concerning the above-named
establishment has been scheduled for 3:30 p.m., January 11, 1994,
in the City Council Chambers, Third Floor, Saint Paul City Hall and
Ramsey County Courthouse.
Enclosed are copies of the proposed resolution and other documents
which will be presented to the City Council for their
consideration. This is an uncontested hearing, in that the facts
contained in the reports concerning the unlawful sale of cigarettes
have been admitted. You will have an opportunity at the Council
hearing to present oral and/or written remarks as to the penalty,
if any, to be imposed. The recommendation of the license office
will be for a$200 fine.
