RESOLVED, that the Licensee, Como Raymond Amoco (L,icense ID No. 71386)
located at 2102 Como Avenue in Saint Paul is hereby ordered to pay a fine of $200 for
the violation of the sale of tobacw or tobacco products to a minor.
Said fine shall be paid to the Office of License, Inspections and Environmental
Protection within thirty (30) days of the adoption of this resolution by the Council and
signature by the Mayor.
This resolution and the action of the Council in ttus matter are based upon the
facts contained in the letter notice of the violation to the licensee, the LIEP inspection

establishment has been scheduled for 3:30 p.m., January 11, 1994,
in the City Council Chambers, Third Floor, Saint Paul City Hall and

Re: Cigarette sale to minor covnpliance check summary
On October 19 and 26, 1994 between the hours of 2:30 p.m. and
5:05 p.m., and on October 22, 1994 between the hours of 10:00 a.m.
and 1:30 p.m., I accompanied Elo Alston, age sixteen, to fifry-five
licensed cigarette retail establishmenu for the purpose of
dete��n;ng if sucb licensees would sell cigarettes to a minor in
violation of Section 324.07 of tbe Saint Paul I.egislative Code and in
violation of Minn. Stat. § 609.68�. Mr. Alston's physical description
is as follows: African American, 5'11", shaved black bair (curly),
weight 180 pounds, thin moustache. On the date(s) and time
period(s) of tbe compliance chec}s, ?vSi. Alston wore a black leatber
jacket and blue jeans. NIr. Alston wore a high scbool class ring on
his right ring �nger (Class of 1995).
It was determined tbat, during the dates specified, fifty-five licensed
cigarette retail establishments would be investigated.
A list of routes bas been pre-establisbed in order to determine
which establishments will be checked a.nd in which order. The order
of the rouu has been set up as close to randomly as possible and
every licensed cigarette retail establishment has been included in the
route system. This is so that the City of Saint Paul can comply with
the obligations associated �Zth their acceptance of the ASSIST
Grant for $5,000 and the �2,0p0 grant from the State of Mianesota
Department of Human Services.
The investigation procedure consisted of sending the minor into
respective listed establishments attempting to purchase a pack of
cigarettes. At no time did the minor produce £alse identification
showing an inconect age. At no time did said minor possess a false
identification cazd or license. After the minor retumed to the car
and informed me of such sale and of which empioyee soid such
tobacco products (identification was made by name tag, physical
description, and by particular counter), I entered the establishment
— and identified m}�self b}� show�n; my badee. I explained that the
sale of cigarettes to a minor �vas made and that this act constituted
a gross misdemeanor pu���hable of up to �500.00, and could result
in adverse action a�ainst .he licence orlicenses held. I then zsked
for their name and recorded it on a copy of the compliance check
slips used as a rewrd of establichmenu checked and as e�zdence
against those who are found notto comply. I recorded any other
relevant commenu or information. If the employee or manager of
tbe estahlishment voiced �ny }and of objection, I responded in clear
terms that due process �c•ould be afforded to them. Receipts were
retained when possible and the cigarette tax number ��as recorded
on the information slip conesponding w�th the establishment in
question. The receipts and cigarettes are given to you in
conjunction with this report.
Of tbe fifty-five establishnents investigated, three ci�arette retailers
did sell cigarettes to said minor. The following is a list of such
licensees, the time of sale and the name of tbe employee wbo
conducted the sale in tbe order they were checked:

Saint Paul City Counc:l that adverse action be taken against a1] the licenses you hold zt
the above-named pre:nises. This recommendztion is based on the follon-ing:
On October 26, 1994, a clerk or other employee sold cigarettes to a minor
under the age of 18 }�ears in the licensed premises. This is an offense
under Minn. St�t. �609.685 and Section 324.07 of the Saint Paul ,
Legis7atit•e Code. This offense is the basis for an action against all your
licenses under Section 310.06(b) of the Legislati��e Code.
The recommendation of this office is a$200 fine for the first offense as called for in the
Saint Paul Legislatice Code as cited above. If you da not dispute the above facts, send
me a fax or letter to that effect v.dthin 5 days. The case w�i]] be set before the City
Council in the near future and you w�ill receive further notice to this regard.
If you do dispute the facts stated above, you may request a hearing before an
Administrative Law Judge (ALJ). The AI.J will hold a trial-type hearing at w�hich both
you and the City will be able to appear and present witnesses, e��dence and cross-
examine the others u�itnesses. The Council will decide the matter at a later public
hearing after it receives the report of the AI.J. Please ]et me know u�ithin 5 days if you
wish this altemate procedure and u�e will take the necessary steps to schedule it for
you. Further questions regarding this process may be directed to Phil Bpme at
266-8710.
Failure to respond will resvlt in an automatic AI.J hearing, and you may be held
responsible for the costs of such hearing.
