1 BE IT HEREBY RESOLVED, that Council File # 95-248, a Resolution adopted by the Council

Paragraph 6. b. (Page 2, Lines 40 through 45) shall be amended to read:
Improvements in or upon the above described easement that do not prohibit the
City from exercising its reserved rights may be allowed by obtaining written
permission from the Department of Public Works Sewer Division with the
understanding that, should the City exercise its reserved easement rights, the City,
at its own eapense, will restore the disturbed area with sod or asphalt to, or
comparable to, its original condition. Restoration and all expenses of landscaping,
trees or shrubbery, or of cobblestone paving or exotic materials shall be the sole
responsibility of the petitioner, its successors and assigns.
22 BE IT FURTHER RESOLVED, that all other terms and conditions of said Council File # 95-
23 248 shall remain in full force and effect.
