other licenses, including Sunday on-sale, off-sale malt, restaurant, and cigarette, held by
Herbert L. Howe dba Cozy Cantina, for the premises at 202 Concord Street in Saint
Paul, are hereby suspended for one (1) day, such suspension to be served on ���; �-��, ,
1995, beginning at 12:01 a.m. and ending at 11:59 p.m. of that day.
FLIRTHER RESOLVED, that this action is based on the police reports of the
incident occurring January 12, 1995, the notice of violation letter dated danuary 20, 1495,
and the admission of the licensee that he does not dispute the facts stated in the notice
of violation letter.

I am in receipt of information that could lead to adverse action
against a11 your licenses. The basis for adverse,action is that:
"On or about 2:30 a.m. on January 12, 1995, police
officers were told by a person outside the Cozy Cantina
that he was waiting for someone in the bar. The officers
looked in the window and saw the bartender behind the bar
and four people sitting at the bar with what appeared to
be beer in glasses in front of them. When the bartender
saw the officers at the window, he took the glasses of
beer from the bar and placed them under the bar. FIe then
came and unlocked the door and let the officers into the
bar."
These actions could be considered by the City Council to violate
sections 409.07 relating to after hours sale, consumption and
display of liquor, and 310.05(6)(a) (relatinq to violations of
law), of the Saint Paul Legislative Code. The owner is responsible
for the conduct of the bartender under sections 409.14 and 310.17
of the Legislative Code.
If you do not dispute the above facts, and wish to have the matter
go directly to the City Council for its determination based on the
above facts and facts contained in the police reports on the
incident, call me at 266-8710 to work out the procedures for that.
If you dispute the facts as I stated them above, or have additional
facts that you wish to introduce in a hearing, I will take the
necessary steps to schedule a hearing before an independent hearing

St, Paul, Sinnesota 55107-2310, and ae have t�een authorized by
corparate diYector Herbert L. Hove to admit that on Sanuary 12,
1995 at 2:30 a.m. ttuae bar customers were on the bar premieea
aftes the closinq hottr of 1:00 a.m. and that lfquar (glasses of
beer) were being consuned or flisplaped oa the premis,es in violation
cf st. Paul C3ty Drdinance 4p9.07 {C}, The bartender in ariarge of
the baT at the time of this violation (Ms. Isadore Zapata) w8s an
experienced bartender azyd v�as fully aware that he was alloming Che
ordfnance to be violated by permittiag the three custoners to be in
the bar consuaing beer after the 1:00 a.m. aiasing hour.
The bartender has been reprimanded and has been re2leved of his
duties ag night bartender at the bar. Mr. Zapata has been confined
ta actinq as a day bartendar, on Saturdays and Sundays, under the
direct supervision of �r. Howe or the other bar manager.
In submitt3nq this matter to the St. Paeil City Counci2 Por its
determinatioa, we believe that it ia also apprepriate to point aut
to the council that:
1- At the time this vialation occurred there was an
individual waiting outside the bar that was seeking a
conProntation with one oE the individuals inside the bar;
the bart�rsder and the customers were waiting in the bar
with the hopPS tbat tAe individual who vas autside vould
get tired af wafting and leave the vicinity of the bar.

Dear Mr. Howe:
I am in receipt of information that could lead to adverse action
against all your licenses. The basis for adverse.action is that:
"On or about 2:30 a.m. on 3anuary 12, 1995, police
officers were told by a person outside the Cozy Cantina
that he was waiting for someone in the bar. The officers
looked in the window and saw the bartender behind the bar
and four people sitting at the bar with what appeared to
be beer in glasses in front of them. When the bartender
saw the officers at the window, he took the glasses of
beer from the bar and placed them under the bar. He then
came and unlocked the door and let the officers into the
bar."
These actions could be con$idered by the City Council to violate
sections 409.07 relating to after hours sale, consumption and
display of liquor, and 310.05(6)(a) (relating to violations of
law), of the Saint Paul Legislative Code. The owner is responsible
for the conduct of the bartender under sections 409.14 and 310.17
of the Legislative Code.
If you do not dispute the above facts, and wish to have the matter
go directly to the City Council for its determination based on the
above facts and facts contained in the police reports on the
incident, call me at 266-8710 to work out the procedures for that.
If you dispute the facts as I stated them above, or have additional
facts that you wish to introduce in a hearing, I will take the
necessary steps to schedule a hearing before an independent hearing

1995 at 2:30 a.m. thres bar customerc were on the bar gremisea
diter the closing hour OP 1:00 a.m. and that lfquar (glasses of
beera qlere being consuned or displaped on the premises in violation
of St. Paul City Ordieance 409.07 {e). The bartender i.n cnarge nf
the bar at trie time vf this violation (Mr. Isadore 2apdta) was an
experienced bartender Aud �ras fully amara that he was alloaeing the
ordinance to be violated by permittinc� the thrae custonars to be in
the bax consvafng beer after the 1:00 a.m. closing hour.
'Phe baztender has been reprimanded and has been relieved of his
duties as night bartender at fiha bar. Mr. Zapata has been confined
to actinq as a day bartender, on Saturdays arid Sundays, under the
