Council File # � 5 — 31y Green Sheet .# � � �, 1 WHEREAS, the Council of the City of Saint Paul, by resolution C.F. 78369, approved October 2 31, 1928, condemned and took an easement in the land necessary for slopes, for cuts and fills in 3 the grading of Hager Avenue (now Birmingham Street) from Maryland Street (now Maryland 4 Avenue) to Lake Como and Phalen Avenue (now Arlington Avenue), and; WHEREAS, the City Council of the City of Saint Paul, by zesolution C.F. 95-248, approved Mazch 8, 1995, vacated land described as follows: 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 �9 30 31 S2 That part of Birmingham Street and Prosperity Avenue described as follows: Beginning at the northeast corner of Lot 5, Block 1, BAUERSCHMIDTS ADDI'I'ION; thence on an assumed bearing of North 00 degrees 00 minutes 56 seconds East along the east line of L.ot 4 said Block 1 a distance of 3.80 feet; thence South 54 degrees 50 minutes OS seconds East 70.00 feet; thence South 19 degrees 50 minutes 12 seconds West 154.05 feet to its intersection with the north line of E. Maryland Avenue; thence westerly along said north line of E. Maryland Avenue 5.00 feet to the southeast corner of Lot 6, said Block 1; thence North 00 degrees 00 minutes 56 seconds East along the east line af said Block 1 to the point of beginning. Except the South 7.00 feet thereof; and WHEREAS, the C�ty of Saint Paul no longer has a need for the easement for slopes, cuts and fills on those properties affected by the above mentioned vaction; and WHEREAS, the petitioner for the above mentioned vacation has requested the release of the siope easements relating to those properties affected by said vacation; RESOLUTION CITY OF SAINT PAUL, MINNESOTA �s-3�� i 2 3 4 5 6 7 8 9 10 11 12 13 14 15 ib 17 18 19 20 21 22 23 NOW 1'HEREFORE BE IT RESOLVED, that the Council of the City of Saint Paul does hereby waive and release the easements for slopes, cuts and fills over the following property: The South 3.80 feet of Lot 4, the North 109 feet of Lot 6, all of Lot 5, and all of the 20 foot alley adjoining Lots 5, 6, '7 and 8 in Block 1, Bauerschmidt's Addition.
