WHEREAS, the Council of the City of Saint Paul, at a Public Hearing on
February 15, 1995, for Council File No: 95-164, ordered the person or persons
responsible for the propezty commonly lmown as 577 Orleans Street, Saint Paul, Ramsey
County, Minnesota to rehabilitate the nuisance building on the subject properry pursuant
to certain terms and conditions recommended by the Legislative Hearing Officer; and
WHEREAS, one of the interested parties, a Mr. Robert Wicker appeared at the
Public Hearing and indicated that he was unable to abide by the terms and conditions
recommended to the Council by the Legislative Hearing Officer. Notwithstanding these
representations, the Council passed the resoludon; and
WHEREAS, a subsequent Public Hearing on the subject property was set before
the Legislative Hearing Officer at the reguest of one of the other parties interested in
the subject property, NorWest Bank, on March 7, 1995. NorWest appeared through their
counsel, Mr. Tom Reiter, esq. Mr. Wicker also appeared. NorWest stated that it would
become the property owner on or about April 2Q 1995. NorWest feared that in the
event that Mr. Wicker did not fulfill his obligations as ordered in Council File No: 95-
164 his malfeasance would cause NorWest to loose the building via a City substanual
abatement action. Mr. Wicker stated that he had now scheduled for March 16, 1495, the
Code Compliance Inspection for the subject property that was required in Council File
No: 95-164; and
WHEREAS, NorWest bank accepted this representation and, based upon that
acceptance, it was the recommendation of the Legislative Hearing Officer that Council
File No: 95-164 be amended again to allow Mr. Wicker the opportunity to, within thirty
(30) days of this Council Hearing, post the sum of two thousand dollars ($2,000.00) in
cash, pursuant to Saint Paul Legislative Code Section 33.03(f� and to otherwise wmply
with the terms of Council File No: 95-164, as amended; and
WHEREAS, in the event that Mr. Wicker does not post the security required
above, NorWest Bank may, upon assuming ownership, post security pursuant ta Saint
Paul Legislative Cofle Section 33.03(� and be given siY (6) months from April 20, 1995
to complete the rehabilitation of the subject properry. NOW, THEREFORE, BE TT

The property owner failed to meet the conditions established in 95-164 and the Legislative Hearing Officer recommends extending the time
for the present properiy owner or the mortgage holder to meet City requirements and begin rehabilitation of this nuisance buiiding.
