95-297ORIG�NAL RESOLUTIOIV Council File # �.� y Ordinance # Green Sheet # � � ��'/ OF SAINT PAUL, MINNESOTA Presented By Referred To Comm.ittee: Date WI�REAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate noise levels in the City of 5aint Paul; and WI�REAS, secdon 293.11 of the Legislative Code authorizes the City Council to grant variances from sound level restrictions in secrion 293.09 upon finding that full compliance with the requirements of the ordinance would constitute an unreasonable hardship on the applicant, on other persons, ar in the community; and WI�REAS, Company 7, Inc., has proposed that a concert be staged on I�arriet Island on Friday, July 14, 1995, and has requested a variance from the restrictions in section 293.11 of the I,egislative Code; and WF�REAS, the Council of the City of Saint Paul conducted a public hearing on said matter on February 16, 1995; now therefore be it RESOLVED, that the Council of the City of Saint Paul hereby grants a variance from the noise level restrictions in section 293.09 of the Legislative Code to Company 7, Inc. for the concert to be staged at Harriet Island on Friday, July 14, 1995, on the following conditions: 2. � The variance shall be in effect from 10:30 a.m. until 11:00 p.m, on Friday, July 14, 1995, only with respect to the concert and related activities taku►g place on Harriet Island. The sound level at the main stage shall not exceed 100 dBA (slow response) measured at the sound mix position located 75 feet from the front of the stage. The sound level at any additional stage(s) shall not exceed 95 dBA (slow response) measured at a location 50 feet distant from the stage. All public address and/or amplifier systems, amplified music, and all other sound producing devices shall be turned off at or before 11:00 p.m. on Friday, July 14, 1995. Company 7, Inc. shall work closely, and cooperate fully, with the City environmental staff to fulfill the goals of the variance, and pernut such staff on site access to, and the ability to inspect all sound equipment to be used at the concert, both before and during the period of the variance and concert. ao 6. Company 7, Inc. shall maintain continuous sound level monitoring throughout the period of the variance, and shall permit City environmental staff to have access to and the ability to inspect such monitoring equipment and the readings registered on such equipment. qs- ag � 7.
