Saint Paul, the proper City officers are hereby auathyorized and directed to pay out of
the Tort Liability Fund 09070-0511 to Michael Adegoke and the Law Office of Trygve A.
Egge the sum of $12,500.00 in full settlement of his claim for damages sustained May 19,
1991, as a result of a motor vehicle accident on University Accident near Fry Street.

Michael Adegoke sued the City for personal injuries received on May
19, 1991, in an motor vehicle accident on University Avenue near
Fry Street. Mr. Adegoke turned his auto on to �'a st bound
University from north bound Fry. His right rear wheel �ell into a
sewer catch basin when the grate protecting the basin collapsed
into the basin. He struck his head, chest, and right leg and hip
ADYANTAGESIFAPPRpVED:
This particular catch basin is of an unusual design, used in only
a few locatiions in the City. It is located not at the curb, but in
the travelled portion of the road way. The City had had prior
problems with this oatch basin, and had made repairs to it in
Ootober of 1989 and again May of 1991, just a few days before the
accident. After this accident, this unusual catch basin was
redesigned and replaced.
DISA�VANTAGES IFAPPROVED:
Mr. Adegoke suffered pain and suffering and had approximately
$17,000 of paid no-fault benefits for medical treatment and lost
waqes.
The settlement amount of $12,500.00 was reached through a court-
ordered, neutral mediation. The terms includes full settlement of
the claims of Mr. Adeqoke and the claims of his no-fault insurer.
