WHEREAS, the City Council oP the City of Saint Paul is concerned
about changes in the telecommunications business and the way it
is regulated and the impact of those changes on the citizens of
the City; and

WHEREA5, there currently are bills before the Minnesota
Legislature which provide for a deregulation of portions of the
telecommunications industry; and
WHEREAS, the impact of deregulation has potential impacts on the
citizens of Saint Paul including the availability of advanced
forms of service throughout the City; possible congestion of
public property with facilities necessary for these services;
additional impact on the use of City streets such as potential
decreased life expectancy of those streets; additional
construction related repetitive disruption of the routine of
daily living including the comfort, safety and welfare of the
citizens; and a potential decline of the relationship between the
City and its existing cable television provider; and
WHEREAS, the inability of cities to require cooperative planning
and coordination of construction projeCts to maximize the
economic benefits such coordination allows and to minimize the
numerous negative impacts caused by repetitive disruption of the
routine of daily living and seve�+Reconomic hardships caused by
continuous tearing up of the public areas of the City; and
WHEREAS, the City Council has reaeived information indicating
that certain Saint Paul neighborhoods may be bypassed by US West
in the installation oP advanced forms of telecommunications
service such as video dialtone and ISDN services, and the City
Council is greatly concerned that some areas of the City and some
citizens may not have adequate access to these services and will
thus be placed at a educational and economic development
disadvantage; and
WHEREAS, participants in the current debate before the
Legislature do not realize that the citizens of Saint Paul have
made tens of millions of dollars in state mandated infrastructure
improvements which are threatened by the multiplicity of
providers and facilities that will occur without some types of
control, and that the above stated unique municipal concerns may
not be understood or appreciated by the parties to the debate at
the Legislature; and

WHEREAS, the Minnesota Public Utilities Commission (MPUC)
currently has pending before it a docket dealing with the
creation of tariffs for US West�s offering of Integrated System
Digital Network (ISDN) services, docket no. P421/EM-94-1200, and
may have other dockets dealing with advanced forms o£
telecommunications services or allowing other providers to offer
services in the City; and
WFIEREAS, the MPUC is seeking public comment on all issues
involving I5DN service including the cost and availability of the
service within the City of Saint Paul; now therefore, be it
RESOLVED, that City Staff are directed to take steps before the
Minnesota Legislature to protect the municipal right to control
the use of the right-of-way by all telecommunication providers
and to oppose legislation which does not offer such protection,
including expressing the stronq opposition to any plans which
allow excluding any City neighborhoods from having the benefits
o£ these new communications seYVices; and be it further
